Zachariah Albaugh to Laurence Powhorn

Ex’ded Granted and del’d   }       At the request of Laurence Powhorn the following deed was recorded
11 July 1805                      }       6 February 1794, to wit ~~~

This Indenture made this fourth day of August in the year of our Lord seventeen hundred and ninety three Between Zachariah Albaugh of Frederick County and State of Maryland, Farmer of the one part and Laurence Powhorn of the same county and State aforesaid, Joiner of the other part.  Witnesseth that the said Zachariah Albaugh for and in consideration  of the sum of seventeen pounds current money to him in hand paid by the said Laurence Powhorn the receipt where of the said Zachariah Albaugh doth hereby acknowledge and himself therewith to be fully satisfied contented and paid and for and in Consideration of the yearly Ground rent of fifteen shillings current money to be paid unto John Young or to his Assigns during his natural life and then to be paid unto Richard Coale his heirs or assigns on the twenty second day of June yearly and every year hereafter forever.  Hath given granted bargained sold aliened released and confirmed, and by these presents doth give grant bargain  sell alien release and confirm unto him the said Laurence Powhorn his heirs  and assigns.  All his the said Zachariah Albaughs tight Title Interest and Property to and of in and to all the following Lots of Ground in the Town of Liberty lying and being in Frederick County aforesaid and on a draught of Linganore called Piney Run being part of a Tract of Land called Duke’s Woods they being back of his and numbered one hundred and ninety four and one hundred and ninety six in the plan of said Town and Beginning at a stone set up on the North side of the Back Street and marked LP and running thence North four degrees West three hundred feet then South eighty six degrees  West one hundred feet then south four degrees, East three hundred feet, then by a straight line to the Beginning containing two of the aforesaid Town Back Lotts, Together with all and singular the Buildings and all the premises and appurtenances  to the said two Lots of Ground belonging or in any wise appertaining   To have and to hold the said Lots of Ground with the premises and Appurtenances thereunto belonging unto him the said Laurence Powhorn his heirs and assigns forever on the condition above mentioned to no other use and Behoof of him the said Laurence Powhorn his Heirs and Assigns.  And the said Zachariah Albaugh for himself and his heirs and assigns doth hereby covenant promise grant and agree to and with the said Laurence Powhorn his heirs and assigns that he the said Zachariah Albaugh his heirs and assigns shall and will from time to time and at all times forever hereafter warrant and defend the said Lott of Ground and  premises with its appurtenances  from by or under him.  The said Zachariah Albaugh doth further covenant for himself  and his heirs to and with the said Laurence Powhorn his heirs and assigns that he the said Zachariah Albaugh his heirs and assigns shall and will from time to time and at all times  forever hereafter at the proper cost and charges of him the said Laurence Powhorn his heirs and assigns do make acknowledge suffer execute or cause to be executed acknowledged all and every such further and other Act or Acts Thing or Things Assurances or Conveyances in the Law as by the said Laurence Powhorn his heirs and assigns or his or their Council  learned in the Law shall be reasonably devised advised or required for this further and better assurances surety and suremaking of all and singular the premises hereby bargained and sold or hereby intended to be bargained and sold according to the true Intent and Meaning of these presents.  In witness whereof the said Zachariah Albaugh hath hereunto set his hand and affixed his seal the day and year within written.

Received the 10th day of August 1793 of Laurence Powhorn the sum of seventeen pounds current Money the consideration  expressed in the within deed.                      John Ross Key  Jn Qwinn

On the 10th day of August 1793 came Zachariah Albaugh before us two of the Justices of the Peace for Frederick County and acknowledged the within Instrument of Writing to be his Act and Deed, and the Lotts and premises therein mentioned to be the Right and Estate of Laurence Powhorn his Heirs and assigns forever.  At the same time came Catharine Albaugh wife of Zachariah Albaugh and being by us privately examined from and out of the Hearing of her said husband and acknowledged her Right and Dower in the within Lotts of Ground and Premises to be the Right and the Estate of the within mentioned Laurence Powhorn his Heirs and Assigns forever and that she did it freely & voluntarily without being induced thereto by Threats or ill usage from her said husband or for fear of gaining his displeasure                                                    John Ross Key             Jn Qwinn
