Zachariah Albaugh to Philip Deale
Land Records, Frederick, MD Examd deld Granted } At the request
of Philip Deale the following Deed was recorded This Indenture made this ninth day of
January in the year of our Lord one thousand seven hundred and eighty nine
Between Conrad Chughall and Zachariah Albaugh of Frederick County and State of
Maryland, Farmers of the one part and Philip Deale of York County and State of
Pennsylvania of the other part Witnesseth that the said Conrad Chughall and
Zachariah Albaugh for and in consideration of the Sum of four hundred pounds
Specie to them in hand paid the receipt whereof the said Conrad Chughall and
Zachariah Albaugh doth hereby acknowledge Hath granted bargained and sold, and
by these presents doth grant bargain sell transfer confirm and make over unto
the said Philip Deale his Heirs and Assigns forever, All that Tract or parcel of
Land called “Slick” being part of a Tract of Land called The Resurvey on Maetogs
Choice lying and being situate in Frederick County Beginning at the end of
thirty six perches on the third Course of Matthia’s Merts part of the aforesaid
Tract called The Resurvey on Maetogs Choice and running thence North sixty seven
degrees East thirty two perches to the end of the tenth line of the afsd
Resurvey – then North five degrees West forty perches North forty degrees East
eighty five perches North fifty four degrees West one hundred and twenty six
perches South forty two degrees West ninety five perches to intersect the third
line of Matthias Merts part of the afsd Resurvey then by a straight line to the
Beginning containing one hundred acres of Land more or less. To Have and to
hold the aforesaid Land and Premises with the appurtenances thereto belonging
or in any wise appertaining unto him the said Philip Deal his Heirs and Assigns
forever and to the only proper use and Behoof of the said Philip Deal his Heirs
and Assigns and no other Use Intent or purpose whatsoever. And the said Conrad
Chughall and Zachariah Albaugh doth for themselves and their Heirs consent and
agree to and with the said Philip Deal and his Heirs and Assigns, that them the
said Conrad Chughall and Zachariah Albaugh and their Heirs the aforesaid Land
and premises with the appurtenances unto him the said Philip Deal and his Heirs
and Assigns will well and sufficiently warrant and forever defend the aforesaid
Land and premises against all manner of persons claiming any Right or Title
thereto by or and or them or any of them, and further the said Conrad Chughall
and Zachariah Albaugh doth for themselves and their Heirs Executors and
Administrators covenant and agree to and with the said Philip Deal his Heirs and
Assigns and every of them that these the said Conrad Chughall and Zachariah
Albaugh and their Heirs shall and will from time to time and at all times
hereafter at the reasonable request and at the proper cost and charges of the
said Philip Deal his Heirs and Assigns make suffer and execute, or cause and
procure to be made done suffered and executed all and every such other Acts or
Instruments of Writing for the further and better conveying and assuring the
hereby bargained Land and premises unto the said Philip Deal his Heirs and
Assigns forever. Provided such other Acts or Deeds contain no other Warranty
than is here by these presents already expected. In witness whereof we have
hereunto set our Hands and Seals this day and year above written his Signed sealed and delivered } Wm Beatty On the back where of were thus endorsed To
Wit ~~ On the 9th day of January 1789
Came Conrad Chughall and Zachariah Albaugh before us two of the Justices for
Frederick County and acknowledged the within Instrument of Writing to be his Act
and Deed and the Land and Premises therein mentioned to be his Right and Estate
of the within named Philip Deal his Heirs and Assigns forever. And at the same
time came Susannah and Mary, wives of the aforesaid Conrad Chughall and
Zachariah Albaugh and being by us privately examined out of the Hearing of their
husbands, and that they did relinquish all their Right and Dower of the within
Land and premises without being compelled or fear of their husbands displeasure.
