John Young to Philip Albaugh

Exam’d and delivered Philip  }   At the request of Philip Albaugh the following Deed was recorded
Albaugh 22 May 1786            }   on the twentieth Day of May Anno Domini 1783.  To Wit.

This Indenture made this seventeenth day of May, in the Year of our Lord one thousand seven hundred and eighty three Between John Young of Frederick County and State of Maryland Farmer of the one part, And Philip Albaugh of the same County and State aforesaid Farmer of the other part  Witnesseth that the said John Young for and in Consideration of the sum of three pounds current Gold and Silver Money to him in hand paid by the said Philip Albaugh, the Receipt whereof the said John Young doth hereby acknowledge, and himself therewith to be fully satisfied contented and paid, and for and in Consideration of the yearly rent of seven shillings and six pence current Gold and Silver Money, to be paid as a Ground Rent, yearly and every year hereafter for ever, which said Annuity to commence on the 22nd day of June last, to the said John Young his Heirs Executors or Administrators hath given granted bargained sold alien’d releas’d and confirm’d and by these Presents doth given grant bargain sell alien release and confirm unto him the said Philip Albaugh his Heirs and Assigns forever.  All his the said John Youngs Right Title Interest and Property of in and to all the following Lott of Ground in this Town of Liberty lying and being in Frederick County aforesaid on a Draught of Linganore call’d Piney Run, it being part of a Tract of Land Duke’s Woods, the said Lott being Number Three of the aforesaid Town Lotts.  Beginning at a Stone sett up on the South side of the Main Street in said Town and mark’d  PA. No. 3 and running thence South four degrees East three hundred Feet.  Thence South eighty six degrees West fifty Feet.  Then North four degrees, West three hundred Feet.  Then by a straight line to the Beginning Containing and laid out for one of the aforesaid Town Lott’s.  Together with all and singular the premises and appurtenances to the said Lott of Ground belonging or in any wise appertaining To Have and to Hold the said Lott of Ground with the premises and appurtenances thereunto belonging unto him the said Philip Albaugh his Heirs and Assigns for ever, on the Conditions above mentioned, to the only proper Use and Behoofs of him the said Philip Albaugh his Heirs and Assigns, and to no other use Intent or purpose whatsoever.  And the said John Young for himself and his Heirs doth hereby covenant  promise grant and agree to and with the said Philip Albaugh his Heirs shall and will from Time to Time, and at all Times forever hereafter warrant and defend the said Lott of Ground and Premises with its ~ Appurtenances against all Manner of Persons claiming or to claim any Right Title Interest or Property unto the aforesaid Lott of Ground with the premises and appurtenances from by or under him the said John Young and his Heirs.  And the said John Young doth further covenant for himself and his Heirs, to and with the said Philip Albaugh his Heirs and Assigns, that he the said John Young and his Heirs shall and will from Time to Time, and at all Times forever hereafter at the proper Costs and Charges of him the said Philip Albaugh his Heirs or Assigns do make acknowledge suffer execute, or cause to be made done acknowledged suffer’d and executed all and every such further and other Act or Acts, Thing or Things, Assurances or Conveyances in the Law, as by the said Philip Albaugh his Heirs or Assigns, or his or their Council learn’d in the Law shall be reasonably devis’d advis’d or required for the further and better Assurances Surety and Suremaking of all and singular the Premises hereby bargained and sold, or intended to be hereby bargain’d and sold, according to the true Intent and Meaning of these Presents.  In Witness whereof the said John Young hath hereunto set his Hand and Seal.

On the back of which Deed were the following Indorsements Viz.

Received the 17th Day of May 1783 of Philip Albaugh the Sum of three pounds current Gold and Silver Money, the Consideration expressed in the within Deed except the yearly Rent of seven Shillings and sixpence current Gold and Silver Money, mentioned as a Ground Rent in the within Deed.   John Young

On the 17th Day of May 1783 Came the within named John Young before Two of the Worshipfull Justices of the Peace for Frederick County, and acknowledged the within Instrument of Writing to be his Act and Deed, and the Lott and Premises therein mentioned to be the Right and Estate of the within named Philip Albaugh his Heirs and Assigns forever.                                 Upton Sheredine
