John Young to John Albaugh
Examd and delivered to John } At the request of John
Albaugh the following Deed was
Albaugh on the 13th Feb 1785 } recorded on the twentieth Day
of May Anno
Domini 1783. To Wit.
This Indenture made the seventeenth Day of May in
the year
of our Lord one thousand seven and eighty three Between John Young of Frederick
County and State of Maryland Farmer of the one part and John Albaugh of the same
County and State aforesaid Farmer of the other part. Witnesseth that the said
John Young for and in Consideration of the Sum of three pounds current Gold and
Silver Money to him in hand paid by the said John Albaugh the Receipt whereof
the said John Young doth hereby acknowledge, and himself therewith to be fully
satisfied contented and paid, and for and in Consideration of the yearly rent of
seven Shillings and six pence current Gold and Silver Money to be paid to the
said John Young, or to his Heirs Executors or Administrators as a Ground Rent
yearly and every year hereafter forever, which said Annuity to commence on the
22nd Day of June last hath given granted bargained sold aliened
releas’d and confirm’d, and by these presents doth give grant bargain sold alien
release and confirm unto him the said John Albaugh his Heirs and Assigns
forever: All his the said John Young’s Right Title Interest and Property of in
and to all the following Lott of Ground in the Town of Liberty lying and being
in Frederick County aforesaid, on a Draught of Linganore called Piney Run, the
said Lott being part of a Tract of Land called Duke’s Woods, the said Lott being
Number Thirty Eight of the aforesaid Town Lotts. Beginning at a Stone marked
IA. No. 30 standing on the South Side of the Main Street of the Town of
Liberty and running thence South four Degrees East three hundred Feet. Then
North eighty six Degrees, East fifty Feet. Then North four Degs’ West three
hundred Feet. Then by a straight Line to the Beginning, containing and laid out
for one of the aforesaid Town Lotts. Together with all and singular the
Buildings and Improvements, and all the premises and appurtenances to the said
Lott of Ground belonging, or in any wise appertaining To have and to hold the
said Lott of Ground, together with the premises and appurtenances thereunto
belonging, on the Condition above mentioned unto him the said John Albaugh his
Heirs and Assigns forever, to the only proper use and Behoofe of him the said
John Albaugh his Heirs and Assigns, and to no other Use Intent or Purpose
whatsoever. And the said John Young for himself and his Heirs doth hereby
covenant promise grant and agree to and with the said John Albaugh his Heirs and
Assigns, that he the said John Young and his Heirs shall and will from time to
time, and at all Times forever hereafter warrant and defend the said Lott of
Ground with the premises and appurtenances thereunto belonging, against all
manner of Persons claiming or to claim any Right Title Interest or Property unto
the aforesaid Lott of Ground with its premises and appurtenances from by or
under him the said John young doth further covenant for himself and his Heirs,
to and with the said John Albaugh his Heirs and Assigns , that he the said John
Young and his Heirs shall and will from time to time, and at all Times forever
hereafter at the proper Costs and Charges of him the said John Albaugh his Heirs
and Assigns do make acknowledge suffer execute, or cause to be made done
acknowledg’d suffer’d and executed all and every such further and other Act or
Acts Thing or Things, Assurances or Conveyances in the Law as by the said John
Albaugh his Heirs or Assigns, or his or their Council learn’d in the Law shall
be reasonably devis’d advis’d or required for the further and better Assurances
Surety and Suremaking of all and singular the premises hereby bargain’d and
sold, or intended to be hereby bargain’d and sold, according to the true Intent
and Meaning of these Presents. In Witness whereof the said John Young hath
hereunto set his Hand and Seal the Day and Year above written.

On the Back of which Deed were endorsed the following
Receipt and Acknowledgment Viz! Received the 7th Day of May 1783 of
John Albaugh the Sum of three pounds current Gold and Silver Money, the
Consideration expressed in the within Deed, except the Sum of seven Shillings
and six pence current Gold and Silver Money, as mentioned in the within
Deed. John Young

On the 7th Day of May 1783 Came the within named
John Young before Two of the Worshipfull Justices of the Peace for Frederick
County and acknowledged the within Instrument of Writing to be his Act and Deed,
and the Lott and Premises therein mentioned to be the Right and estate of the
within named John Albaugh his Heirs and Assigns
