John Young to David Albaugh
Land Records, Frederick Maryland Exam’d deliv’d John Whitnacht } At the request of
David Albaugh the following This Indenture made the twenty fifth day of April in the year of our Lord one thousand seven hundred and eighty six Between John Young of Frederick County and State of Maryland Farmer of one part and David Albaugh a Cooper of the same County and State aforesaid of the other part Witnesseth that the said John Young for and in Consideration of the Sum of three pounds fifteen Shillings Current Gold and Silver Money to him in hand paid by the said David Albaugh, the receipt whereof the said John Young doth hereby acknowledge and for and in Consideration of the yearly Rent of seven shillings and six pence Current Gold and Silver Money to be paid to Richard Cole or to his Heirs Executors Administrators yearly and every year forever, which said Annuity to commence on the 22nd Day of June last hath given granted bargained sold aliened releast and confirm’d and by these presents doth give grant bargain sell alien release and confirm the said John Youngs Right Title Interest and Property of in and to all the following Lott of Ground at the Town of Liberty in Frederick County aforesaid on a Draught of Linganore called Piney Run it being part of a Tract of Land called Dukes Woods, the said Lott of Ground, not numbered, lying on the East side of a back Lott Number one hundred and ninety three joining the aforesaid Lott in the said Town in the North Street on the East side Beginning at a Stone marked DÆ (AB together) and running thence North four degrees West three hundred Feet then South eighty six degrees West Fifty feet then south four degrees East three hundred feet- then by a straight line to the Beginning containing one of the Town Lotts. Together with all and singular the Buildings and Improvements and all the premises and Appurtenances to the said Lott belonging , belonging, or in any wise appertaining. To have and to hold the said Lott of Ground together with the premises and Appurtenances on the conditions above mentioned unto him this said David Albaugh his Heirs and Assigns forever, to the only proper use and Behoof of him the said David Albaugh his Heirs and Assigns and to no other use Intent or purpose whatsoever. And the said John Young for himself and his Heirs doth hereby consonant promise grant and agree to and with the said David Albaugh his heirs and Assigns, that he the said John Young and his Heirs shall and will from Time to Time, and at all Times forever hereafter warrant and defend the said Lot of Ground and premises with its Appurtenances against all manner of Persons claiming or to claim any Right Title or Interest or property unto the aforesaid Lott of Ground, and premises with its Appurtenances from by or under him the said John Young and his heirs. And the said John Young doth further consonant for himself and his Heirs to and with the said David Albaugh his Heirs and Assigns, that he the said John Young and his Heirs shall and will from Time to Time, and at all Times forever hereafter at the proper Cost and Charges for him the said David Albaugh his Heirs or Assigns do make acknowledge suffer execute or cause to be made done acknowledged suffered and executed all and every such further, and other Act or Acts Thing or Things or Conveyances in the Law, as by the said David Albaugh his Heirs and Assigns, or his or their Council learn’d in the Law shall be reasonable devis’d advis’d or required for the further and better Assurances Surety and Suremaking of all and singular the premises hereby bargained and sold or intended to be bargained and sold according to the true Intent and Meaning of these presents. Young (seal) On the back whereof more of the following Endorsements to wit~ Received the 25th Day of April 1786 of David Albaugh the Sum of three pounds fifteen Shillings Current Gold and Silver Money the Consideration afores’d in the within Deed except the yearly Rent of Seven Shillings and six Pence Current Gold and Silver Money as mentioned in the within Deed Witness Upton Sheredine Wm Beatty John Young On the 25th Day of April 1786 Came the within named John Young before us two of the Worshipfull Justices of the Peace for Frederick County, and acknowledge the within Instrument of Writing to be his Act and deed, and the Lott of Ground and premises therein mentioned to be the Right and Estate of the within named David Albaugh his Heirs and Assigns forever.
