William Albaugh to Zachariah Danner

Ex’d del’d Granted                               At the request of Zachariah Danner the following Deed was
5th February 1802                                  recorded July 4th 1800 to wit ~~

This Indenture made the sixteenth day of June in the year of our Lord one thousand eight hundred Between William Albaugh son of John of Frederick County and State of Maryland of the one part and Zachariah Danner of the same County and State aforesaid of the other part   Witnesseth that the said William Albaugh for and in consideration of the sum of fifty one pounds current money of the State aforesaid to him in hand paid by the said Zachariah Danner at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged Hath granted bargained and sold  and by these presents doth grant Bargain and sell unto him the said Zachariah Danner his heirs and assigns all that tract or parcel of Land situate lying and being in Frederick County in the State aforesaid being part of a Tract of Land called Eve’s Lot (said Eve’s Lot being part of a Tract of Land called the resurvey on Albaughs Choice)  Beginning for the out lines of the said Tract or parcel of land hereby Intended to be Conveyed at a stone planted at the end of the seventh line of the Tract of Land called Eve’s Lot and running thence North thirty and a quarter Degrees East Sixty five and a half perches to a stone South seventy seven & a quarter Degrees East thirty one and a quarter perches to a stone erected at the end of Fourteen perches on the Sixth line of the above mentioned tract of land called Eve’s Lot and with said line South Twenty Degrees West forty two perches to a stone planted at the end thereof then with a straight line to the first beginning Containing Twelve acres of land more or less Together with all and singular the Improvements and advantages with the appurtenances to the said Tract or parcel of land belonging or in any wise appertaining .  To have and to hold the said Tract or parcel of land hereby intended to be conveyed and every part and parcel thereof with the appurtenances  unto the said Zachariah Danner his heirs and assigns to the only proper use and behoof of the said Zachariah Danner his heirs and assigns forever ~~  And the said William Albaugh for himself his heirs Doth covenant grant and agree to and with the said Zachariah Danner his heirs and assigns that he the said William Albaugh and his heirs the said Tract or parcel of land and promises unto him the aforesaid Zachariah Danner his heirs and assigns as well against him the said William Albaugh his heirs and assigns as against all and every other person and persons whatsoever claiming or that shall or may hereafter claim any right or title thereto by from or under him them or any of them shall and will warrant and forever defend by these presents  And  lastly the he the said William Albaugh and his heirs shall and will at any time hereafter at the reasonable request  of and at the proper cost and charges in the law of him the said Zachariah Danner his heirs and assigns execute and acknowledge any other Deed or Instrument of Writing  as shall or may be thought Lawfully necessary for the better and more sure and perfect granting and conveying in fee Simple by Like Warranty the within described Tract or parcel of land unto him the said Zachariah Danner his heirs and assigns forever agreeable to the True Intent and meaning of these presents.  In witness whereof the said William Albaugh hath hereunto set his hand and affixed his seal the day and year above written.

On the back of the foregoing Deed was thus Indorsed to wit ~~
On the 16th Day of June 1800 Received of Zachariah Danner the sum of Fifty one pounds, it being the consideration within mentioned.                       Rec’d by William Albough

Frederick County          On the Sixteenth day of June 1800 came the within named William Albaugh before us the subscribers two of the Justices of the Peace for said County and acknowledged the within Instrument of Writing to be his Act and Deed and the Tract or parcel of land and premises thereby granted to be the right and Estate of the within named Zachariah Danner his heirs and Assigns forever according to the True Intent and meaning if the said Deed and the Act of Assembly in such case made & provided.
