William Albaugh to Peter Fine

Exam’d   }           At the Request of Peter Fine the following Deed was Recorded 15 August 1779. 
Deliv’d   }           To Wit ~~  Whereas on or about the Twentieth Day of May in the year of our Lord one thousand seven hundred and sixty nine William Albaugh obtained out of Frederick County Court his Lordships the Lord Depository(?) Writ of Attachment Commanding the Sheriff of the said County Court to attach any the Goods and Chattels Land and Tenements of a certain Peter Fine for the sum of Twenty nine pounds Thirteen Shillings and seven pence Current Money due and owing from the said Peter Fine to the said William Albaugh In consequence of which attachment the said Sheriff to wit ~  Norman Bruce Esquire Attached and Levied by Virtue of the said Writ a Tract or Parcel of Land called Hopsons Choice Lying and Being in the said County Containing one hundred and Fifty Acres which the said Sheriff Returned and the Court awarded Condemnation there in at Term Court in the year seventeen hundred and sixty nine ~~ and since the aforesaid Condemnation the said Peter Fine has appeared and fully paid and to him paid the said William Albaugh as well the Damages aforesaid being twenty nine pounds thirteen shillings and seven pence Current money all costs and charges arising on the attachment ~    As this Indenture Witnesseth that for and in consideration of the Premises as also for the further consideration of the sum of Five Shillings to the said William Albaugh in hand paid by the said Peter Fine the Receipt whereof the said William Albaugh doth hereby acknowledge and himself fully Satisfied Contented and paid he the said William Albaugh doth hereby Surrendered and Released and forever Quit Claim and by these Presents for himself and his Heirs doth Surrender Release and forever Quit Claim unto him the said Peter Fine his Heirs and Assigns all the Tract or Parcel of Land called Hopsons Choice containing one hundred and fifty acres which was Condemned by virtue of an Attachment issued out of Frederick County Court for the use of the said William Albaugh as above Recited.   To have and to hold the said Tract or Parcel of Land called Hopsons Choice into him the said Peter Fine his heirs and Assigns forever so as with he the said William Albaugh nor his Heirs shall or may at any time here after as the claim or claims Challenge or Demand and Right Title Interest  Claim or Demand  whatsoever
