William Albaugh to John Albaugh

Exam’d     }  At the Request of John Albaugh the following Deed Recorded the 20th day of June
Deliv’d      }  1766 to wit,  This Indenture made this Twentieth day of June seventeen Hundred and sixty six Between William Albaugh of Frederick County and Province of Maryland, Farmer of the one part and John Albaugh of same place, Farmer of the other part  Witnesseth that the said William Albaugh for and in Consideration of the Sum of one hundred pounds Sterling to him in hand paid by the said John Albaugh before the ensealing and and Delivery of these presents the Receipt whereof the said William Albaugh Doth hereby Acknowledge and thereof and of every part and parcel thereof Doth  acquit Discharge the said John Albough his heirs and Assigns forever Hath given Granted Bargained Sold Aliened Conformed and made over and by these presents Doth give Grant Bargain Sell Alien Confirm and make over unto the said John Albaugh his Heirs and Assigns forever all that Tract or Parcel of Land called Chestnut Level Beginning at the End of Twenty perches on the Sixth Line of a Tract of Land called Albaughs Choice and running thence South seventy Degrees West thirty four perches North seventy seven degrees West forty perches North Twenty Degrees West forty perches North Sixty perches North Eighteen degrees West Eighty perches North Thirty five degrees West thirty four perches North seventy six Degrees East Twenty eight perches South seventy degrees East Seventy four perches North thirty degrees East forty one perches North eighty nine degrees East sixty perches to the end of the eighth line of the Married Mans Delight then with said Land resurvey South Sixty two Degrees East twenty six perches South twenty three degrees East forty perches South Twenty four degrees and a half degree East forty perches South twenty four degrees and half degree East forty perches South twenty six Degrees East forty four perches South East forty perches South one hundred perches South eighty degrees, West forty seven perches to the end of the sixth line of Albaughs Choice then with a straight line to the Beginning Containing and now laid out for Two hundred and seventy seven acres of Land more or less  To have and to hold the above said Tract of Land called Chestnut Level and premises with the appurtenances thereunto belonging or in any ways appertaining unto him the said John Albaugh his heirs and Assigns forever and the said William Albaugh doth for himself his heirs Executors and Administrators Covenant Grant and agree to and with the said John Albaugh his heirs and Assigns forever that he the said William Albaugh and his heirs the afs’d Tract of Land called Chestnut Level and premises afs’d with the appurtenances unto him the said John Albaugh his heirs and Assigns forever from and against all manner of persons whatsoever claiming any Right or Title thereunto from by or under him or them will well and truly warrant and forever Defend and further the said William Albaugh doth for him’s his Heirs Executors and Administrators Covenant and agree to and with the said John Albaugh his Heirs and Assigns that he the said William Albaugh his heirs Executors or Administrators shall and will from time to time and at all Times hereafter at the reasonable request and at the proper Cost and Charge of the said John Albaugh his Heirs or Assigns make us suffer or cause to be made suffered and executed all and every such other and further act or acts, deed or Deeds conveyance or Conveyances Asurance or Assurances whatsoever for the further and better conveying and assuring the hereby bargained Land and premises unto the said John Albaugh his Heirs and Assigns forever be it by acknowledgment or by Enrolement or by any other ways or means as by his or their Council Learned in the Law shall be reasonably advised devised or required  In witness whereof I have hereunto set my hand and affixed my seal the day and year written.

On the back of which Deed was their indorsed  to wit }
June the 20th 1766 Then received of John Albaugh the sum of one hundred pounds Sterling being the Consideration money within mentioned                                                    William Albaugh

Memorandum       June the 20th 1766 came William Albaugh before us the Subscibers Two of his Lordships Justices of the Peace for Frederick County and Acknowledged the within Instrument of Writing to be his Act and Deed and the Land and premises therein mentioned to be the Right ans Estate of the within named John Albaugh his Heirs and Assigns forever according to an Act of Assembly such cases late made and provided.  At the same time came Magdelane Albough wife of the said William Albaugh who being by us privately examined out of the hearing of the said husband relinquished her Right of Dower to the within mentioned Land and Premises and acknowledged the same to be the Right and Estate of the within named John Albaugh his Heirs and Assigns forever and declared she did the same willingly and freely without being compelled there to by fears or threats of the said husband for fear of his displeasure

Received the 20th day of June 1766 of the within mentioned John Albaugh Eleven shillings and one penny and half penny sterling as an alienation fine of the within mentioned Two hundred and seventy seven acres of Land by order of Edward Floyd Esquire, Agent of his Lordship the Right  Honorable the Lord Proprietary of Maryland.                                    John Darnell
