Ex’d } At the request of Eve Albaugh the
following Deed recorded August the 29th Grant }
1758 To Wit ~~
This Indenture made this twenty ninth day of August in the year of our
Lord one Thousand seven hundred and fifty eight Between William Albaugh of
Frederick County and Province of Maryland of the one part and Eve Albaugh
Daughter of Zachariah Albaugh of the County and Province afs of the other part.
Witnesseth that the said William Albaugh for and in consideration of the Sum of
fifty pounds Current money to him in hand paid by His said Eve Albaugh before
the Inscribing and Delivery of these Presents the receipt whereof is hereby
acknowledged Hath granted Bargain and sold and by these presents doth hereby
bargain and sell unto her the said Eve Albaugh all that Tract or Parcel of Land
called Eaves Lott being part of a tract of Land called Resurvey on Albaughs
Choice Situate lying and being in the County afs Beginning at the Beginning of
the afs resurvey and running thence eight? perches north thirty eight degrees
East *Sixty *perches then South seventy degrees East forty perches then South
Fifty nine degrees East sixty perches then south seventy six degrees East twenty
perches then North Eighty degrees East Forty perches then South twenty degrees
West Fifty six perches then South Twenty eight degrees and a half degree West
Fifty perches then South twenty five degrees West Thirty Six perches then South
three degrees West one hundred perches then South Forty three degrees West
twenty perches then South Sixteen degrees West Twenty six perches then South
fifty five degrees West Twenty Eight perches then South Twenty five degrees West
Twenty Eight perches then North Eight degrees west one hundred perches then
North twenty four degrees West Thirty perches then by a straight line to the
Beginning containing one hundred and Seventy seven acres of Land more or Less
Together with all the appurtenances whatsoever to the same belonging or on
anywise appertaining To have and to hold the said Land and Premises with all
and Singular the appurtenances thereunto belonging unto the said Eve Albaugh her
Heirs and assigns forever and to the only proper use and Behoof of her the said
Eave Albaugh her heirs and Assigns and to otherwise Intent or Purpose and the
said William Albaugh for himself his heirs Executors and Administrators doth
covenant and agree to and with the said Eave Albaugh her heirs and Assigns that
he the said William Albaugh his Heirs Executors Administrators shall and will
warrant and forever defend the afs Land and premises unto her the said Eave
Albaugh her Heirs and Assigns against all persons whatsoever that Shall or may
claim any right Title Interest of in or to the same or any part therein from by
or under him and also shall and will at the request and at the Cost and Charge
of her the said Eave Albaugh
Her heirs and Assigns at any time hereafter do make
Acknowledge Suffer and Execute any other Deed or Deeds or other Instrument of
writing that this said Eve Albaugh her heirs or Assigns or her or their Council
learned in the Law shall and may reasonably devise or acquire for the further
and better assurances Surety and Suremaking of all and Singular the said Land
and premises unto her the said Eve Albough her Heirs and Assigns forever
provided that such other Deed or Deeds or another Instrument of Writing that the
said Eave Albough her heirs and Assigns or her or their council learned in the
law shall or may devise advise require no other warranted then is Intended by
the above~~~
Instrument of Writing In Witness whereof the said William
Albaugh hath hereunto set his hand and affixed his seal the day and Year above

On the back of the foregoing Deed was the following
Endorsements to Wit ~~
Received this 29th day of August 1758 of Eve Albough the sum of fifty
pounds or current Money being the consideration Money for the within mentioned
Land and premises I say received

On the 29th day of August came William Albough
party to the within mentioned Land before us two of his Lordship Justices of the
Peace for Frederick County and Acknowledge the within mentioned Land and
Premises to be the right and Estate of the mentioned Eave Albough heir heirs and
Assigns forever according to Act of Assembly in that case made and provided and
at the same time came Magdeline wife of the above said William Albaugh and being
examined out of the hearing of her husband declares that she doth relinquish
all her right of claiming Dower of in and to the within mentioned Land and
premises and that she doth the same freely and voluntarily and was not compelled
thereto by threats of or ill usage by her husband or for fear of his
displeasure. Acknowledged before Thos Beatty Jos Wood

Albough the sum of Seven shillings and seven pence sterling as an alternation?
Fine on the within mentioned one hundred and seventy seven acres of Land by
order of Edward Loyd Esqr Agent of his Lordship the Lord Pre*** of Maryland
