May 14, 1791 William Albaugh to Daniel Etzler
Examined, Delivered } At the
request of Daniel Etzler the following deed was
Granted 23 March 1797 } recorded 14th May 1791 to wit~
This Indenture made this twenty seventh day of December in
the year of our Lord one thousand seven hundred and ninety Between William
Albaugh of Frederick County and State of Maryland, Farmer of the one part and
Daniel Etsler of the same county and state aforesaid Waggonmaker of the other
part Witnesseth that the said William Albaugh for and in consideration
of the sum of one hundred and seven pounds two shillings current money to him in
hand paid by the said Daniel Etzler the receipt whereof the said William Albaugh
doth hereby acknowledge and himself therewith to be fully satisfied contented
and paid and forever Hath given granted, bargain, sold aliened released and
confirmed and by there presents doth give grant bargain sell alien place and
confirm unto heirs the said Daniel Etzler his heirs and assigns forever. All
his the said William Albaughs' Right Title Interest Claim and property of in and
to all the following track or parcel of land lying and being in Frederick
aforesaid and called “Sapling Hill” Beginning at the fourteenth line of a
track or parcel of land called The Refusory* on Albaugh Choice and running
thence North twenty four degrees west one hundred and seventy six perches then
south thirty three degrees and half degree West eighty perches then South thirty
two perches then South nineteen degrees East forty six perches then with a
straight line to the Beginning containing and laid out for sixty one acres of
Land more or less in the County aforesaid Together with all and singular the
Buildings Gardens Water and Water Courses and all the premises thereunto
belonging or in any wise appertaining to Have and to hold the said Tract or parcel of land
with the premises and appurtenances unto him the said Daniel Etzler his heirs
and assigns forever on the conditions above mentioned to no other use intent or
purpose whatsoever. And the said William Albaugh doth hereby consonant for himself, and his heirs doth promises grant and agree to and with the said
Daniel Etzler his Heirs and Assigns that he the said William Albaugh his Heirs
Executors and Administrators shall and will from time to time and at all times
forever hereafter warrant and defend the said tract or parcel of ground and
transfer with its Appurtenances against all manner of persons claiming or to any right Title Interest or property unto the aforesaid Tract or parcel and
promises with its appurtenances from by or under him the said William Albaugh
his Heirs Executors Administrators and Assigns. And he the said William
Albaugh his Heirs and Assigns doth further consonant for himself and his Heirs
and Assigns and to and with the said Daniel Etzler his Heirs and Assigns that he
the said William Albaugh and his Heirs shall and will from time to time and at
all forever hereafter at the proper cost and Charges of him the said Daniel
Etzler his Heirs and Assigns do make acknowledge suffer execute or cause to be
made done acknowledged suffered and executed all and every such Sureties and the
Act or Acts Thing or Things Assurances or Conveyances in the Law as by the said
Daniel Etzler his Heirs or Assigns or his or their Council learned in the Law
shall be reasonably devised advised or required for the further or and better
Assurances Surety and Suremaking of all or singular the premises hereby
bargained and sold or to be hereby intended to be sold according to the true
Intent and Meaning of these presents. In Witness whereof the said William
Albaugh hath hereunto set his hand and affixed his Seal the day and year within

Received 27th December 1790 of Daniel Etzler one hundred and seven pounds
current money the Consideration expressed in the within Deed.

On the 27th day of December 1790 Came William Albaugh
before two Justice of the Peace for Frederick County and acknowledged the
written Instrument of Writing to be his Act and Deed and the Land and premises
therein to be the Right and Estate of the within named Daniel Etzler his Heirs
and Assigns forever Upton Sheredine

On the 29th day of January 1791 Came Modelena Albaugh Wife
of the said William Albaugh and being by us privately examined from and out of
the hearing of her said husband and acknowledged her right and Dower tp
and of the within Land and premises to be the Right of the aforesaid David
Etzler his Heirs and Assigns forever and that she did the same freely and
voluntarily without being induced thereunto by fear or Threats or ill usage from
her Husband or for Fear of his displeasure. Upton
