William Albaugh to Daniel Etzler

Ex’d and deliv’d  Granted                       At the request of Daniel Etzler the following deed was
March 23rd 1822                                    recorded the 2nd day of August 1803.  to wit ~~

This Indenture made the seventh day of April in the year of our Lord one thousand eight hundred and three  Between William Albaugh son of John of Frederick County and State of Maryland  of the one part and Daniel Etzler of the same county and state aforesaid of the other part.  Witnesseth that the said William Albaugh for and in consideration of the sum of six hundred and twenty three pounds eight shillings and nine pence current money of the State aforesaid to him in hand paid by the said Daniel Etzler at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, hath granted, bargained, and sold, and by these presents doth grant bargain and sell unto him the said Daniel Etzler his heirs and assigns all the following described parcel of land being part of a tract of Land called “Eve’s Lot” (said Eves Lot being part of a tract of land called the Resurvey on Albaugh’s Choice) situate in the county aforesaid.  Beginning for the part hereby bargained and sold at the beginning of the aforesaid resurvey and running thence with the out lines of the above land called Eve’s Lot six courses North thirty eight degrees East sixty perches to a stone planted South seventy four degrees East forty perches to a stone planted South twenty degrees West fourteen perches to a stone planted at the end of the second line of Zacharias Danner’s part of the aforesaid land called Eve’s Lot and with the outlines thereof reversed two courses North seventy seven and a quarter degrees west sixty five and a half perches to a stone planted at the end of the seventh line of the aforesaid land called Eve’s Lot and with the outlines thereof South twenty five degrees West thirty six perches to a stone planted South three degrees west one hundred perches to a stone planted South forty three degrees west twenty perches to a stone planted south sixteen degrees West twenty six perches to a stone planted South fifty five degrees West twenty eight perches to a stone planted South seventy four degrees West twenty eight perches to a stone planted North eight degrees West one hundred perches to a stone planted then with a straight line to the first beginning containing one hundred and sixty six and a quarter acres of Land more or less.  Together with all and singular the improvements and advantages with the appurtenances the said Tract of Land belonging or in anywise appertaining and all the estate right title interest property claim and demand of him the said William Albaugh his heirs and assigns of in and to the said parcel of Land and premises and every part thereof.  To have and to hold the said parcel of Land above described and every part and parcel thereof with the appurtenances to the said Daniel Etzler his heirs and assigns to the only proper use and behoof of the said Daniel Etzler his heirs and assigns forever.  And the said William Albaugh for himself and his heirs doth covenant, grant and agree to and with the said Daniel Etzler his heirs and assigns that he the said William Albaugh and his heirs the said parcel of Land and premises with the appurtenances unto him the said Daniel Etzler his heirs and assigns, as well against him the said William Albaugh and his heirs as against all and every other person and persons claiming the same by from or under him them or any of them shall and will warrant and forever defend by these presents.   In witness whereof the said William Albaugh hath hereunto set his hand and affixed his seal the day and year above written.

Frederick County                   On the seventh day of April 1803 came the within named William Albaugh before us the subscribers two Justices of the Peace for the county aforesaid and acknowledged the within Instrument of Writing to be his act and deed and the land and premises therein mentioned to be conveyed to be thought and estate of the within named Daniel Etzler his heirs and assigns forever according to the true intent and meaning of the said deed and the act of assembly in such cases made and provided
