William Albaugh to Rinehard & Charity Waltz

 

Examd and Delivd to         }   At the Request of Rinehard and Charity Waltz’s the following Deed
Rinehard Waltz on the       }   was Recorded March the 1st Anno Domini 1781 To Wit ~~

                 This Indenture made this Seventeenth day of February in the year of our Lord One Thousand seven hundred and Eighty One  Between William Albaugh of Frederick County in the State of Maryland, farmer of the one part and Rhinehard Waltz and Charity Waltz of the County and State aforesaid Baron and Tome of the other part Witnesseth that the said William Albaugh for and in consideration of the sum of forty pounds current Money to him in hand paid by the said Rinehart Waltz and Charity Waltz the receipt whereof he doth hereby acknowledge  and for diverse cause other causes and considerations him thereunto moving hath granted bargained sold aliened expressed and confirmed and by these presents doth grant bargain  sell alien express and confirm unto them the said Rinehart Waltz and Charity Waltz all that Tract of parcel of Land called Charity’s Choice being part of a Tract of Land called the resurvey on Alboughs Choice situate and lying and being in the County aforesaid Beginning at the end of forty perches on the sixteenth Course of the resurvey aforesaid and running thence South thirty three degrees and an half an degree  West forty perches South thirty two perches   South nineteen degrees East twenty three perches South forty four degrees West One hundred and fourteen perches South seventy five degrees west twenty perches North two degrees East twenty perches North twenty four degrees west forty perches North nine degrees East twenty perches North thirty eight degrees West twenty eight perches north seventy eight degrees East twenty two perches North thirty eight degrees East forty six perches North twelve degrees East thirty perches North thirty perches Then by a straight line to the beginning and laid out for Ninety Acres of Land more or less To have and to hold the said Land and Premises with all and singular the appurtenances to the same belonging unto them the said Rinehard Waltz and Charity Waltz and to the Heirs of the said Charity Waltz forever to the only proper use and behoof of them the said Rineheart Waltz and Charity Waltz and to the Heirs of the said Charity and to no other use intent or purpose whatever And the said William Albaugh for himself and his Heirs do Covenant and agree to and with the said Rinehart Waltz and Charity Waltz and the Heirs of the said Charity that he the said William Albaugh and his Heirs shall and will warrant and forever defend the said land and premises unto them the said Rinehart Waltz and Charity Waltz and the Heirs of the said Charity against all manner of persons claiming or to claim any Right Title or Interest to or in the same or any part or parcel thereof from by or under him the said William Albaugh and his Heirs  or any of them and further to make and execute any other Deed or Instrument of Writing which may be reasonably devised advised and required for the surety and Sure making the Land and premises  Provided the said Deed or Instrument shall contain no other warranty than is hereby given and the parties aforesaid for themselves and their respective Heirs and Assigns doth farther Covenant and Agree to and with each other.  That this Deed of Conveyances shall be and is hereby intended to be a good and sufficient Barr against any claim which maybe set up, or made to the land and premises aforesaid or any part or parcel thereof in Virtue of or under a Deed of Conveyance from the said William Albaugh to the said Charity whilst she the said Charity was sd bearing date the twenty ninth day of August one thousand seven hundred and fifty eight.  In Witness whereof the parties to these presents have interchangeably set their hands and affixed their Seals this day and year first above written.

The proceeding Deed was thus Indorsed To Wit~~

Received this 17th day of February 1781 the sum of Forty pounds current Money of Rinehard Waltz & Charity Waltz, it being the Consideration Money within mentioned as Witness
Test.  Upton Sheredine     Abraham Albaugh           Rineheart              Wm Albaugh

On the  17th day of February 17 1781 Came the within named William Albaugh before us two of the Justices of the Peace for Frederick County and acknowledged the within Deed to be his Act and Deed and the land and premises therein mentioned to be the Right and Estate of the said Rinehart Waltz and Charity Waltz and Charity Waltz and the Heirs of the said Charity forever  According to the true Intent and Meaning of the said Deed and at same time came Magdalona Albaugh wife of the said William Albaugh and being by us privately examined and out of the hearing of her said husband Acknowledged her right of Dower in the said land and premises to be the Right and estate of the said Rinehart Waltz and Charity and the Heirs of the said  and that she did the same freely and Voluntarily without being induced there to by fear or threats of her said husband or for fear of his displeasure               Upton Sheredine
