John Wilson to Christian Albaugh

 

This Indenture made this twenty fifth day of April, in the year of our Lord one thousand and eight hundred and forty six by and between John Wilson and Elizabeth, his wife, of the County of Jefferson, in the State of Ohio of the one part and Christian Albaugh of the County and State aforesaid of the other part.  Witnesseth that the said John Wilson and Elizabeth his wife, for and in consideration of the sum of Twelve hundred dollars to them in hand paid, the receipt whereof they do hereby acknowledge have given, granted, bargained and sold, released and conveyed and do by these presence give, grant, bargain, sell, release, convey and confirm unto the said Christian Albaugh and his heirs and assigns forever all the tract or parcel of land situate and being in the County of Jefferson, in the State of Ohio, known and distinguished by being the west half of the south east quarter of section numbered twenty five in Township numbered Ten of Range number three in the Steubenville Land office District which was convey to him the said John Wilson by Wm. P. Phillips and his wife which is recorded in the recorders office in Jefferson County, Ohio.  To have and to hold the premises aforesaid with all the privileges and appurtenances thereunto belonging or in anywise appertaining  unto him the said Christian Albaugh and unto his heirs and assigns forever and said John Wilson and Elizabeth his wife, for themselves and their heirs, executors and administrators covenant and promise to and with the said Christian Albaugh, his heirs and assigns that they the said John Wilson  and Elizabeth his wife, are lawfully seized of the premises aforesaid that they have good right and lawful authority to sell and convey the same in manner aforesaid and that the premises are free and clear of and from all incumbrances whatever and further that the said John Wilson and Elizabeth his wife, will well and truly warrant and forever defend the premises herein and hereby granted unto the said Christian Albaugh and to his heirs and assigns against  the lawful claims and demands of all and every person whomsoever person whomsoever.  In testimony whereof the said John Wilson and Elizabeth his wife, party of the first part have hereunto set their hands and seals the day and year above written.

(Seal)    On the second day of May in the year A.D. one thousand eight hundred and forty six, before the subscriber, a Justice of the Peace, within and for said County, personally appeared the said John Wilson and Elizabeth Wilson, wife of the said John Wilson, being by me examined separate and apart from her said husband and the contents of said deed being fully made known to her by reading the same in her presence she did declare upon such separate examination that she did voluntarily sign, seal, and acknowledge the same and that she is still satisfied therewith.  Given under my hand and seal the day and year aforesaid.
