Be it concerning bond that heretofore to wit at a Court of Common Pleas began
and held at the Court House in Carrollton on Monday the Fifth day of October in the year
of our Lord, one thousand eight hundred and forty one.
On motion of R M Clare Esq, the last will and testament of William
Myers Sr. was brought into court the two subscribing witnesses directs to wit:
Joseph Cable and Daniel M Cook, came before and say that the said Deceased signed and
subscribed said Will at the end thereof in the presence of the said witnesses that the
said witnesses attested and signed said Will in the presence of the deceased, that the
Testator at the time of the Execution of said Will was of sound mind and memory and under
no restraint which testimony whereby reduced to writing and filed and it appearing to the
court that the said Will was duly executed attested and proven as aforesaid the same is
admitted to probate, Thereupon the court order that Letters of Testimony ~ issue unto
Robert M Eldery the Executor named in said Will, that he give Bond according to the Law in
the penal sum of $400 with Elisha McGuire* and Samuel Sterling as his securities who are
approved as such. Thereupon George N. Bulles*, David Workman and Geo. Beatty are
appointed appraisers of property, and which said Will is in words and figures as follows
to wit:
In the name of God Amen
I William Myers Sr of the Town of Carrollton in the County of Carroll
Ohio, Being weak in body of sound mind and memory, do make and ordain this instrument of
writing, to be my last Will and Testament to wit,
First it is my will that all my just debts and funeral expenses be
fully paid as soon after my decease as circumstances will admit
Second I will and bequeath unto my son William Myers a note I hold on
him calling for One hundred Dollars dated *th day of Feby anno Domini 1837 with any legal
interest that may be due thereon~
Third I give and bequeath to my son in law James Crist a note I
hold on him made payable to William Thompson dated 31st Jany 1837 calling for Fifty
Dollars and satisfied by Thompson to one on the 11th of April 1837.
Forth I give and bequeath unto Sarah Allbaugh
a certain receipt for One hundred Dollars which I paid unto John S. Hunter
for her debts 1st April 1835.
Fifth I give and bequeath unto Mary Crist wife of James
Crist the sum of One hundred Dollars to be paid to her by my executor herein after named
out of the proceeds of my personal Estate if so much remains after the payment of my other
debts and if any of said One hundred Dollars be unpaid to her at the death of my
wife Elizabeth Myers then the ballance to be paid to her in the manner on said Seventh
Item on this Will
Sixth I give unto my wife Elizabeth Myers the residue of my
Estate both real and personal during her natural life hereby authorizing my Executor to
sell my Real Estate (being the undivided half of Lot No Fifty six *** sons Addition to the
Town of Centerville now Carrollton being the property on which I now reside, the other
half of said Lot now belongs to the Estate of David I. *ecy Decd - ) at any time when the
same may be necessay to support my said Wife - after the proceeds of my personal Estate is
exhausted in her support,
Seventh it is my Will that the ballance of said Estate in
the hands of my Executor at the death of my said Wife shall be disposed of in the manner
following
First, the amount due to Mary Criss of the One
hundred Dollars willed to her by
the Fifth Item of this Will
be paid to her with legal interest on the Ballance from
Eight months after my decease, and the
ballance then in the hands of my said
Executor after the closing of this Final
account, be divided between my three
Daughters Sarah Allbaugh,
Mary Crist and Elizabeth Lery Share and share alike
Lastly I do hereby constitute and appoint Robert M Eldery Esq.
Executor of this my last Will and Testament revoking and annulling all former Wills by me
made and I do hereby authorize my Executor to pay Eli Myers my son the sum of One hundred
Dollars out of my money in his hands which in addition to the sum I have already paid him
shall be in full of the proportion of my Estate. In testimony whereof I have
hereunto set my signature and seal this 22nd July 1841

Thereupon Letters of Testamentary were issued unto the said Robert M Eldery and Recorded
in Letters Record A Page 102.
