Be it remembered that heretofore to
wit at a Court of Common Plea began and held at the Court House in Carrollton on Monday
the twenty nineth day of April in the year of our Lord one thousand eight hundred and
forty four in and for said County and State of Ohio.
On motion of George W. Beldon Esq. the Last
Will and Testament of William Allbaugh Decsd was brought into court the two subscribing
witnesses to wit Isaac Loppin and John P.Lannes came into court and have been duly
sworn depose and say that the Decd did sign said Will at the end thereof in the presence
of the witnesses, that witnesses did attest and sign the above as 'witnesses in the
presence of the Decd and at the request of the Decd that the Testator at the time of
signing said Will was of sound mind and memory of full age and not under any restraint
which - testimony is hereby reduced to writing and filed and the Court being fully
satisfied that said Will was duly executed attested and proven, the same is admitted to
Probate, Merceyson(?) the Widow of said William Allbaugh elects to take under the Will of
her late husband in lieu of Dower which election is approved by the Court. "And which
said Will is in the words and frazzes as follows to wit"
In the Name of the Benevolent Father of all, I
William Allbaugh of the County of Carroll and the State of Ohio do make and publish
this my last Will and Testament in manner and form following. Namely, I give
and bequeath to my beloved wife Mary Allbaugh, In lieu of her Dower the sole and entire
occupancy right title and interest in and to the following described premises for and
during her natural life, viz. - The East half of the North east quarter of section Twenty
four in Township fifteen of Range seven in the Steubenville land district - containing
Eighty four acres and forty two hundredth of an acre situate in the County of Tuscarawas
and State of Ohio - Also a part of the North West quarter of section
eighteen in Township fifteen in Range seven in the Steubenville Land District as aforesaid
Bounded as follows viz., beginning at the North West corner of (symbol) quarter section
Thence south one hundred and twelve perches, thence North sixty seven degrees East thirty
four perches, thence North seventy seven degrees, East twelve perches thence East nineteen
perches, thence North seven degrees, West thirty two perches, thence North thirty five
degrees, East twenty perches, thence North forty two degrees, East twelve
perches, thence North twenty six Degrees East ten perches Thence North twenty nine perches
thence west eighty perches to the place of beginning containing Forty four acres situate
in Carroll County Ohio, together with all improvements, water courses, profits and
Apurtenance what so ever to the said premises or on any use Appertaining, and also all the
Rents proffits and issues that may be due from or growing up on or out of premises
at the time of my Decease together with all the Goods and Chattle Rights moneys and
effects which of Right belong to me at this time or, may belong to me at the time of my
death after my funeral expenses and other just claims are paid as for debts at the
present time I have none to my knowledge
And furthermore I give and
bequeath (in consideration of Natural Effection) to my two sons Levi & Samuel Allbaugh
at the death of my said wife Mary the two lots of land as above described for a further
description of said lots see deed from Frederick Roof and wife to William Allbaugh dated
May 5th A.D. 1831. Also Deed from Ezra Allbaugh & wife to William Allbaugh dated
December twenty fifth A.D. 1837 which said lots of Land are bequeathed to my two sons as
above stated on the condition that they pay to my Daughters viz. Lidia, Catharine &
Ana
Allbaugh the sum of three hundred Dollars to be paid within or at the expiration of twelve
months from the Death of my said wife Mary Allbaugh, which is sum of three hundred Dollars
I bequeath as follows viz. to Lidia Allbaugh one hundred dollars and to Ann Allbaugh one
hundred Dollars, and to Catherine Allbaugh one hundred Dollars.
I do hereby revoke all former wills by
me made. In testimony, whereof I have hereunto set my hand and seal this 23rd day of
December A.D. 1843.

At a court of Common Pleas begun and held at the court house in the
town of New Philadelphia within and for the County of Tuscarawas and State of
Ohio on Monday the 11th day of March A.D. 1844 among other proceedings then and
there made the following to wit..
The last will and testament of William Albaugh was this day
brought into court and the witnesses said will viz. Israel S. Lappin and John P.
Laimer came before the court and being duly sworn depose and say that the said
deceased signed and subscribed the said will at the end thereof in the presence
of said witnesses that they said witnesses attested and subscribed the said will
as witnesses in the presence of said deceased and that the testator at the time
of executing said will was of full age, of sound mind and memory and not under
any restraint, which testimony is hereby reduced to writing and filed. And
it appearing to the court that said will was duly attested executed and proved
as aforesaid the sum is admitted to probate. Thereupon Mary Albaugh, the
widow of said deceased came into court and elects to take under said will in
lieu of dower.
