Nathan U. Walker to John Allaback

 

Know all men by these presents that I Nathan U. Walker and Sarah Jane wife of said N.U. Walker of the County of Columbiana and State of Ohio for and in consideration of the sum of One hundred and twenty five dollars to me paid in hand by John Allaback of the County of Jefferson and State aforesaid, do by these presents give, grant, bargain, sell and convey unto the said John Allaback his heirs and assigns forever, the following described lot of ground, to wit, Lot No. Five in the Town of Richmond Jefferson County, State of Ohio, the Lot owned by Joseph McCarl being on the west and Jess Mitchell on the East.  To have and to hold said Lot with privileges there unto belonging unto himself his heirs and assigns forever.  And furthermore the said Nathan U. Walker and Sarah Jane his wife doth hereby covenant that they are lawfully seized of the premises aforesaid and have good right to sell and convey the same and that it is free and clear from all incumbrances and that they will forever warrant and defend the same with its privileges unto the said John Allaback his heirs and assigns against the lawful claim of all persons whomsoever.  In testimony whereof, we have hereunto set our hands and seals this twenty seventh day of September One thousand eight hundred and forty nine.

On the 27th day of September 1849 personally came before me the undersigned authority in aforesaid County, Nathan U. Walker and Sarah J. Walker his wife & acknowledged the signing & sealing of the within deed to be their free act & deed, the said Sarah J. having been by me examined separate & apart from her said husband & the same having been read to her by me ~ she did declare & say on such examination that she did voluntarily & of her own free will & accord without fear or coertion from her said husband, sign seal and acknowledge the same “Given under my hand and seal this day & year above written.
