Luke Tipton to Levi & Madison Albaugh



Know all men by these presents that we Luke Tipton and Achsa Tipton wife of said Luke Tipton of the County of Jefferson and State of Ohio, for and in consideration of the sum of Twenty two hundred dollars to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold, and by these presents do grant, bargain, sell, convey, and confirm unto Levi and Madison Albaugh of the County of Jefferson and State of Ohio, their heirs or assigns all the following described Land with the appurtenances.  Situate and described as follows, Being a part of South west quarter of Section Number 24, in Township No. 9 and Range No. 3, of the Steubenville land District in the county of Jefferson and State of Ohio.  Beginning at a stone in the south boundary of said section, running thence S89 3/10º E, 86 perches with  S. line of section to a stone west bank of Cross Creek; N30¼º E, 11 2/10 perches up with said creek; N19¾ºE, 4 7/10 perches, N59¼ºE, 16 1/10 perches; N84ºE, 12 4/10 perches S75ºE, 5 5/10 perches to the centre line of the section, thence North 100 perches with the centre line of the Section to Cross Creek N47¾ºW, 14 8/10 perches with Cross Creek, N32¾ºW, 14 perches; N71¾ºW, 8 perches; S23¾ºW, 21 perches; S10½ºW, 14 perches; S7ºW, 61 perches with woodses now to the place of beginning, containing Seventy two acres more or less, Railroad claims excepted.  To have and to hold the above described Tract of Land and premises, with the appurtenances, unto the said Levi and Madison Albaugh their heirs and assigns forever.  And the said Luke Tipton and Achsa his wife for themselves and for their heirs, executors and administrators hereby covenant unto the said Levi and Madison Albaugh their heirs and assigns that they are lawfully seized of the premises aforesaid, that they are free and clear from all incumbrances whatsoever.  And that they will forever warrant and defend the same unto the said Levi and Madison Albaugh their heirs and assigns against all lawful claims whatsoever.  In Testimony whereof the aforesaid Luke Tipton and Achsa his wife have hereunto  set their hands and seals this Thirteenth day of March A.D. 1861.

The State of Ohio, Jefferson County SS.
L.S.   On the thirteenth day of March in the year of our Lord one thousand eight hundred and sixty one before the subscriber a Justice of the Peace in and for said county, personally appeared the said Luke Tipton and Achsa wife who signed and sealed the foregoing deed, and acknowledged the signing & sealing thereof to be their act and deed for the purpose therein expressed.  And the said Achsa, wife of the said Luke Tipton being by me examined separate and apart from her said husband and the contents of the said deed being made known unto her by reading the same in her presence, she did declare upon such separate examination that she did voluntarily sign, seal and acknowledge the same and she is still satisfied therewith.
