Will of Susan (Rothrock?) Albaugh The Last Will and Testament of Susan Albaugh. I, Susan Albaugh of Frederick Town in Frederick County in the State of Maryland, now the wife of William H. Albaugh, of the same Town, County and State, and being of sound mind, memory and understanding, and acting of my own free Will and accord and free from any influence or attempted influence by my said Husband. Do make and ordain this my Last Will and Testament in manner following: Imprimis: I commit my body to the earth and my soul to God who gave it. Item: I give, devise and bequeath all the property and Estate whether Real personal or mixed of which I am now seized or possessed or to which I am in any way entitled, of which I may be seized or possessed at the time of my death, whereas on the same may be situate unto my said husband William H. Albaugh, his heirs and assigns forever. And Lastly. I hereby constitute and appoint my said husband William H. Albaugh, sole Executor of this my last Will and Testament. In Testimony whereof I hereunto subscribe my name and affix my seal on this thirteenth day of August, in the year Eighteen hundred and fifty five. Susanna Albaugh (seal) Signed, Sealed, published and declared by Susan Albaugh, the Testatrix, as and for her Last Will and Testament, in the presence of us, the subscribed make sign our names as witnesses hereto in the presence of the said Testatrix, and at her request, and in the presence of each other - The said Susan Albaugh, having bases first privately examined by us the subscribers apart and out of the presence and hearing of her husband William H. Albaugh, whether she doth make the same will freely and voluntarily and without being induced thereto by fear or threats of, or all usage by her said husband, and she the said Testatrix having said that she doth so willing and freely. Albaugh, the husband of the above named Testatrix hereby subscribe my consent to the making and executing of the aforegoing Last Will and Testament by the said Testatrix.. William H. Albaugh William H. Ways Dan H. Rohr J.M. Harding State of Maryland, Frederick County, Sct: On this 21st day of May 1862, came William H. Albaugh and made oath on the Holy Evangely of Almighty God, that the aforegoing instrument of writing is the true whole Will and Testament of Susanna Albaugh late of Frederick County, deceased, that has come to his hands and possession, that he received the same from the Testatrix possession for delivery, and that he does not know of any other of a later date. Test: A. R. Kessler, Regr State of Maryland, Frederick County, Sct: On the 29th day of May 1862, came Wm H. Ways, Dan H. Rohr & J.M. Harding, the subscribing Witnesses to the aforegoing last Will and Testament of Susanna Albaugh, late of said County, deceased and that they did see Susanna Albaugh, the Testatrix therein named sign and seal this Will; that they heard her publish, pronounce, and declare the same to be her last will and testament, that at the time of her so doing she was to the best of their apprehension of sound and disposing mind, memory and understanding and that they respectively subscribed their names as witnesses to said Will, in the presence, and at the request of the Testatrix and that they did also see each other subscribing witnesses sign his name as witness to said Will at the request of the Testatrix in her presence, and all in the presence of each other.
