Samuel Albaugh to Mary Weigle

Exd deld  Wm H. Albaugh   ~                             At the request of Mary Weigle the following Mortgage
June 12th 1832  ~~                                          is recorded July 23rd A.D. 1831

This Indenture made this 13th day of July in the year of Our Lord Eighteen Hundred & thirty one between Samuel Albaugh, of Frederick County & State of Maryland of the one part and Mary Weigle, of the county & state aforesaid, of the other part; Whereas  the said Samuel Albaugh, by his note or obligation bearing even date with these presents stands indebted to the said Mary Weigle in the sum of five hundred dollars, current money, payable five years after date and the interest to be paid annually and whereas the said Samuel Albaugh in order to secure to the said Mary Weigle the payment of the amount of the note or obligation aforesaid with the interest accruing thereon at the time therein limited hath agreed to execute these presents.  Now this Indenture  Witnesseth that the said Samuel Albaugh in consideration of the premises and for and in consideration of five dollars, current money, to him in hand paid before the sealing & delivery of these presents, the receipt whereof he the said Samuel Albaugh, doth hereby acknowledge hath granted, bargained, sold, aliened, released, enfeoffed and confirmed and by these presents doth grant, bargain, sell, alien, release, enfeoff and confirm unto her, the said Mary Weigle and her heirs and assigns forever, all the following described piece or parcel of ground situate lying and being in Frederick town in the County & State aforesaid being part of that parcel of ground which was conveyed by John Mantz to William and David Hane by deed dated on or about the fifteenth day of May one thousand eight hundred & seventeen and afterwards conveyed to the said John Hane by John Nelson Esquire, Trustee under a decree of Frederick County as Court of Chancery by deed dated on or about the twenty eighth day of June, one thousand eight hundred twenty seven  Beginning for the part of said lot hereby intended to be conveyed at the South west corner of said lot so as aforesaid conveyed to said John Hane & running with all Saints Street West one hundred & eighty eight feet, North thirty one feet, East one hundred and eighty feet then South with Market Street thirty one feet to the Beginning; Together with the rights, members and appurtenances thereunto belonging or in any wise appertaining and the version and reversions, remainder & remainders, rents, issues and profits thereof and all the Estate, right, title, interest, property, claim and demand, whatever, legal and equitable of him, the said Saml Albaugh in and to the said piece or parcel of ground & premises hereby bargained and sold or meant, mentioned or intended hereby so to be and every or any part & parcel thereof with the rights, members and appurtenances unto the said Mary Weigle & her heirs & assigns forever to the only proper use & benefit & behoof of her, the said Mary Weigle & her heirs and assigns forever and to or for no other use, intent or purpose whatsoever: Provided nevertheless and it is the true intent & meaning of these presents & of the parties to the same that if the said Samuel Albaugh, his heirs, executors and administrators do and Shall well and truly pay and satisfy unto the said Mary Weigle, her heirs, executors, administrators or assigns the aforesaid sum of Five hundred dollars current money with the interest accruing thereon at the time limited in the note or obligation aforesaid, then these presents and every matter and clause therein contained to be utterly null and void, anything herein contained to the contrary thereof in anywise notwithstanding.  In witness whereof the said Samuel Albaugh hath hereunto set his hand and seal the day & year first herein before written.

Maryland, Frederick County, to wit:  On the 23rd  day of July in the year of our Lord eighteen hundred & thirty one personally appeared Samuel Albaugh before the subscribers, Justices of the Peace for the county aforesaid and acknowledges the aforegoing deed or instrument of writing to be his act and deed according to the true intent and meaning thereof and the Act of Assembly in such case made & provided.
