Samuel Allaback to Joseph Russel

 

Know all men by these presents that we Samuel Allaback and Catharine Allaback his wife of the County of Columbiana Ohio, in consideration of the sum of Eight hundred Dollars in hand paid by Joseph Russel of the County of Jefferson and State aforesaid have bargained and sold and do hereby grant, bargain, sell and convey unto the said Joseph Russel his heirs and assigns forever the following premises situate in Jefferson County and State of Ohio, and in the district of Lands subject to sale at Steubenville being the East half of the South West Quarter of Section Twenty  ________  in Township Nine of Range Two containing Eighty two acres and ninety two hundredths of an acre more or less.  To have and to hold said premises, with the appurtenances unto the said Joseph Russel his heirs and assigns forever.  And the said Samuel Allaback for himself and heirs doth hereby covenant with said Joseph Russel his heirs and assigns, that he is lawfully seized of the premises aforesaid.  That the premises are free and clear from all incumbrances whatsoever and that he will forever warrant and defend the same with the appurtenances unto the said Joseph Russel his heirs and assigns against the lawful claims of all persons wheresoever.   In testimony whereof the said Samuel Allaback and Catharine Allaback have hereunto set their hands and seal this twenty sixth day of March in the year of our Lord One Thousand eight hundred and forty nine.

The State of Ohio, Columbiana County SS.

Before me William Workman a Justice of the Peace in and for said County personally appeared the within named Samuel Allaback and Catharine his wife and acknowledged the signing and sealing of the within conveyance to be their voluntary act and deed, and the said Catharine being at the same time examined by me separate and apart from her said husband and the contents of said instrument made hereunto her by me, she then declared that she did voluntarily sign seal and acknowledge the same and that she is still satisfied thereunto.  Given under my hand and seal this 26th day of March A.D. 1849.
