Jacob Row to Wm H. Albaugh

Exd & delvd, Grantee            }                             At the request of William H. Albaugh the following
June 3rd 1833                       }                             Deed is recorded 15th October 1831

This Indenture made this sixth day of October in the year one thousand eight hundred and thirty one Between Jacob Row & Susanna his wife of Frederick County & State of Maryland of the one part and William H. Albaugh of the same county & state of the other part:  Witnesseth that the said Jacob Row & Susanna Row his wife for and in consideration of the sum of Three hundred dollars current money to them in hand paid before the sealing and delivery of these presents, the receipt whereof the said Jacob Row & Susanna his wife do hereby acknowledge have granted, bargained, sold, aliened, released, enfeoffed and confirmed, and by these presents do grant, bargain, sell, alien, release, enfeoff and confirm unto the said William H. Albaugh his heirs and assigns forever.  All that Lot or portion of ground lying and being in the Addition to Frederick Town in the county & State aforesaid known and distinguished  by Lot Number Two hundred & thirty five and fronting on Fifth Street in said town sixty feet and running back three hundred & ninety three feet to Sixth Street more or less Together with the right, members and appurtenances thereunto belonging, or in any wise appertaining and the reversion and reversions, remainder and remainders, rents, issues, and profits thereof, and all the estate, right, title, interest, property, claim and demand whatever legal and equitable, of them the said Jacob Row and Susanna his wife in and to the said Lot of ground and premises, hereby bargained and sold with the rights, members and appurtenances, and every or any part and parcel thereof:  To have and to hold the said lot of ground and premises hereby bargained and sold, or meant, mentioned or intended hereby so to be, and every or any part and parcel thereof, with the rights, members and appurtenances, unto the said William H. Albaugh his heirs and assigns forever, to the only proper use and benefit and behoof of him the said William H. Albaugh and his heirs and assigns forever, and to and for no other use, intent or purpose whatsoever.  And the said Jacob Row & Susanna his wife for themselves their heirs executors and administrators do covenant, grant, promise and agree to and with the said William H. Albaugh and his heirs executors and administrators and assigns that they the said Jacob Row & Susanna his wife, and their heirs, the said Lot of ground and premises hereby bargained and sold and every part and parcel thereof, with the rights, members and appurtenances to him the said William H. Albaugh and to his heirs and assigns against them the said Jacob Row & Susanna his wife and their heirs and against every person and all persons whatever now claiming or hereafter may claim any right title or interest in or to the same or any part thereof by from or under him or them, shall and will hereafter warrant and forever defend by these presents.  In witness whereof the said Jacob Row & Susanna his wife have hereunto set their hands and seals the day and year first herein before written.

 which is thus endorsed, viz ~
Maryland Frederick County, to wit:

Be it remembered that on this day the sixth day of October in the year one thousand eight hundred and thirty one personally appear Jacob Row and Susanna Row the grantors named in the foregoing Deed or instrument of writing, and the Lot of ground and premises therein mentioned, and every part and parcel thereof, with the rights, members and appurtenances to be the right, title and estate of William H. Albaugh the grantee also therein named his heirs and assigns forever, according to the true intent and meaning thereof and the acts of Assembly in such cases made and provided.  And the said Susanna wife of the within named Jacob Row acknowledged the foregoing instrument of writing to be her act and deed, and the Lot of ground and premises therein mentioned to be the right and estate of the within named William  H. Albaugh his heirs and assigns; and being asked whether she doth make her acknowledgment of the same willingly and freely, without being induced thereto by fear or threats of or ill usage by said husband or fear of his displeasure answers and says that she did make her acknowledgement  of the same willingly and freely without being induced thereto by fear or threats of or ill usage by her said husband or fear of his displeasure which said acknowledgement and examination of the said Susanna was made and taken privately out of the hearing of said husband and we did see her sign and seal the said deed out of the presence & hearing of her husband Executors & acknowledges before us the subscribers two Justices of the peace of the state of Maryland for Frederick County.    Jno McDonald
