Peter Albaugh to Frederick & Sarah Ridgley
Land Records, Frederick, MD Ex’d del’d Granted } At
the request of Peter Albaugh & Frederick Ridgely & wife the This Instrument of writing of two parts made
the twenty first day of March in the year of our Lord eighteen hundred and
twelve between Peter Albaugh of Frederick County Maryland of the one part and
Frederick Ridgeley and Sarah his wife, of the other part. Witnesseth, that
whereas Peter Albaugh senior, late of said County deceased, by his last Will and
Testament, devised to his son Peter his plantation, or tract of land, whereon he
then lived and hereafter to be described, except sixty acres to his daughter
Sarah now the wife of the said Frederick Ridgely to be laid off on the North
West side of the land as described in the Will, and Whereas the said parties for
their better conveniency and satisfaction, have concluded, the sixty acres so
devised to the said Sarah shall be laid off, on the South East side of land ~
the estate, or tract of Land so devised and hereby intended to be divided lying
and being in the County aforesaid, being part of a tract of Land called the
resurvey on Welch Cabbin, and the parties to hold and enjoy their respective
parts thereof in severalty, it is therefore covenanted and agreed, by and
between all and every of the said parties for himself and herself, and each of
their respective heirs, executors and adm. And they do hereby severally and
respectively covenant, grant and agree to, and with the others, their several
and respective heirs and assigns, that a Partition of the same shall be and is
hereby made and determined in manner following, that is to say, that the said
Peter Albaugh his heirs and assigns shall and may from henceforth have, hold,
possess and enjoy in severalty , the part of said Land included in the following
courses and distances. Beginning at the end of the nineteenth line of the said
Resurvey on Welch Cabbin, and running thence with said land North twenty eight
and three quarter degr East thirty six prs to a stone North seven and three
quarters degs East twenty six prs to a stone at the root of a large white oak
tree marked XXI North twenty two and a quarter degs West thirty two prs
to a stone North sixty nine and three quarters degr East one hundred and forty
pers to a stone North forty two and three quarters degs East thirty prs to a
stone, South fifty nine and a quarter degs East eighty five and a half pers then
with the division lines between the said parties, South forty four degs West one
hundred and ninety six pers South six and a half degs West twenty five and half
prs to a stone at the end of the ninth line of the said tract hereby intended to
be divided, then with the remainder of the out lines of the same South forty
five and three quarters degs West eighty prs to a stone, North thirty four and a
quarter degs West seventy seven prs to a stone then North sixty nine and three
quarters degs East three & half prs to a stone then North three quarters of a
deg East forty six prs to the beginning containing one hundred eighty two and
quarter acres more or less. And the said Frederick Ridgely and Sarah his wife,
for themselves their heirs executors & adm., do by these presents grant, release
and confirm, the same to the said Peter Albaugh his heirs and assigns, forever,
as and for the said Peter Albaughs full share part and portion of, in and to the
said land. To have and to hold the same, with all the privileges and
appurtenances thereof, to him the said Peter Albaugh, his heirs and assigns,
forever, in severalty as afsd and to his and their only use and behoof forever
and the said Frederick Ridgely and Sarah his wife do severally by these
presents, for themselves and their heirs and assigns that he and they shall and
may from hence forth, have, hold, use, occupy, possess & enjoy the same free and
discharged of all right, title, interest, claim and demand whatsoever, of the
said Frederick Ridgely and Sarah his wife or either of them or of their heirs or
assigns, or any person or persons claiming from by or under them or any of
theirs. Secondly, that the said Frederick Ridgeley and Sarah his wife their
heirs and assigns, shall and may from henceforth have, hold, possess and enjoy
in severalty the part or parcel of said land included in the following courses
and distances, Beginning at a stone set for the end of the ninth line of said
tract also standing in the ninth of the line between said Peter Albaugh and Noah
Phillips and running thence with the division line between the said parties
North six & a half degs East twenty five and a half prs to the end of eighty
five and a half prs on the sixth line of said tract and with it, South fifty
nine and a quarter degs East forty four and a half prs to a stone, South forty
three and three quarters degs West seventy four and three quarter prs to a stone
South forty five degs West one hundred and forty and one quarter prs to a stone
then North sixty six and one quarter degs West twenty nine and one quarter prs
to the beginning, containing sixty acres more or less and the said Peter Albaugh
for himself and his heirs Exrs and adms do by these presents grant, release and
confirm the same to the said Frederick Ridgley and Sarah his wife their heirs
and assigns, forever, as and for their full share, part and proportion, of, in
and to the said Land so divided as aforesaid, to have and to hold, the same,
with all the privileges and appurtenances thereof, to them the said Frederick
Ridgeley and Sarah his wife their heirs and assigns, forever, in severalty as
afsd and to their only use and behoof, forever, and the said Peter Albaugh do by
these presents for himself and his heirs, or assigns, that he the said Frederick
Ridgeley and Sarah shall and may from hence forth forever, peaceably and quietly
have hold, use, occupy, possess and enjoy the same free and discharged of all
right, title, interest, claim and demand whatsoever, of the said Peter Albaugh
or his heirs or assigns or of any person or persons claiming from by or under
them. In witness whereof the said Peter Albaugh, Frederick Ridgeley and Sarah
his wife in token of their free consent hereto have hereunto interchangeably set
their hands and seals the day and year first within written ~~
Which is thus endorsed, to wit ~~ On this 21st day of March in the year of our Lord 1812 Personally appeared the within named Peter Albaugh before us two Justices of the Peace for the county afsd and did acknowledge the foregoing Instrument of Writing to be his act and deed and the land and premises as described for the part laid off to the said Frederick and Sarah Ridgeley to be the part portion and share of said land and the right and estate of the said Frederick Ridgeley and Sarah his wife their heirs and assigns forever ~ Also at the same time came the within named Frederick Ridgeley and Sarah and did also severally acknowledge the aforegoing Instrument of Writing to be their act and deed and the part of land therein described to be the part portion and share of the said Peter Albaugh his heirs and assigns forever, according to the true intent and meaning thereof and the acts of assembly in such case made and provided.
