Peter Albaugh to Noah Philips

} At the request of Noah Philips the following deed is
recorded This Indenture made this twelfth day of April one thousand eight hundred and sixteen Between Peter Albaugh of Frederick County and State of Maryland of the one part and Noah Philips of the county and State aforesaid of the other part. Witnesseth that the said Peter Albaugh for and in consideration of the sum of Five thousand seven hundred dollars current money to him in hand paid and secured to be paid by the said Noah Philips the receipt whereof he the said Peter Albaugh doth hereby acknowledge and himself fully satisfied contented and paid have bargained and sold, aliened, enfeoffed and confirmed and by these presents doth bargain and sell, alien, enfeoff and confirm unto the said Noah Philips his heirs and assigns forever ~ Part of a tract of Land lying and being in the County and State aforesaid Being part of a Tract of Land called the Resurvey on Welch Cabbin - Beginning for said part at the end of the nineteenth line of said Resurvey and running thence North twenty eight and three quarter degrees East thirty six perches to a stone North seven and three quarter degrees East twenty six perches to a stone North forty two and one quarter degrees West thirty perches to a stone North sixty nine and three quarter degrees East one hundred and forty perches to a stone North forty two and three quarters degrees East thirty perches to a stone South fifty nine and one quarter degrees East eighty eight and a half perches South forty three degrees West one hundred and ninety six perches South six and a half degrees to a stone West twenty five and a half perches to a stone South forty two and three quarter degrees West eighty perches to a stone North thirty four and one quarter West twenty seven perches to a stone North sixty nine and three quarter of a degree East three and a half perches to a stone North three quarter of a degree East forty six perches to the Beginning containing one hundred and eighty four acres of Land more or less together with all buildings improvements and other appurtenances unto the same belonging or in any wise appertaining. To have and to hold all and singular the aforesaid part of Tract of Land and premises thereunto belonging or in any wise appertaining unto him the said Noah Philips his heirs and assigns forever and to and for mo other use intent or purpose whatsoever and the said Peter Albaugh for himself and his heirs executors and administrators doth covenant and agree to and with the said Noah Philips his heirs and assigns that he the said Peter Albaugh his heirs executors and Administrators shall and will warrant and forever defend the said Land and premises unto him the said Noah Philips his heirs and assigns, against all manner of persons whatsoever claiming or that shall or may hereafter claim any right or title to the same or any part thereof from by or under him and also shall and will at the reasonable request and proper cost and charges of him the said Noah Philips his heirs or assigns or his or their council learned in the Law shall or may reasonably advise devise or require do make acknowledge and execute any other deed or Instrument of writing that he the said Noah Philips his heirs or assigns shall advise devise or require for the more effectual surety and sure making of the aforesaid Land and premises unto the said Noah Philips his heirs and assigns Provided that such other deed or Instrument of Writing that the said Noah Philips his heirs or assigns shall advise devise or require be no other warrantee than is intended by the above deed or Instrument of writing agreeable to the true intent and meaning thereof. In Witness whereof the said Peter Albaugh hath hereunto set his hand and affixed his seal the day and year first above herein written ~ Signed Sealed and delivered
} Peter Albaugh (seal) Which is thus endorsed, to wit; Md Frdk County, to wit, On the day and year
mentioned in the within deed or Instrument of writing before us the subscribers
two Justices of the Peace of the State in and the County aforesaid personally
appeared Peter Albaugh and acknowledged the within deed or Instrument of writing
to be his act and deed and the Land and premises therein mentioned to be the
right and estate of Noah Philips his heirs and assigns forever according to the
true intent and meaning thereof and the act of Assembly in such case made and
provided and now at the same time also appears Barbara Albaugh wife to the said
Peter Albaugh who did also acknowledge the within mentioned Land and premises to
be the right and estate of Noah Philips his heirs and assigns forever and being
by us privately examined apart from and out of the hearing of her said husband
whether she made the same of her own voluntary free will declared she made the
same of her own voluntary free will and was not induced or compelled thereto by
fear or threats from a ill usage of her the said husband or through fear of his
displeasure
