Peter Albaugh to Joshua Dilloplane & Wm Pittinger

Exam’d deliv’d Hedjah Collins }  At the request of Joshua Dilloplane and William
Order 17 Febr 1790                 }  Pittinger the following Mortgage was recorded on
                                               the ninth day of August anno Domini seventeen
                                               hundred and eighty eight to wit~

This Indenture made this ninth day of August in the year of our Lord seventeen hundred and eighty eight  Between Peter Albaugh of Frederick County and State of Maryland of the one part and Joshua Delaplane and William Pittinger of the same place of the other part.  Witnesseth  that the said Peter Albaugh for and in consideration of the sum of four hundred and fifty pounds current money to him in hand paid by the said Joshua Delaplane and William Pittinger the receipt whereof is hereby acknowledged Hath granted bargained sold aliened confirmed and made over by these presents doth grant bargain sell alien confirm and make over unto the said Joshua Delaplane and William Pittinger their Heirs Executors Administrators and Assigns forever.  All that Tract of Land called The Two Brothers, being part of a Tract of Land called the resurvey on Welch Cabbin situate lying and being in the County aforesaid Beginning at the end of the nineteenth line of The Resurvey on Welch Cabbin, and running thence North thirty one degrees East thirty two perches then North seventy two degrees East one hundred and forty perches then North forty five degrees East thirty perches then South fifty seven degrees East one hundred and thirty perches then South forty five degrees West one hundred and sixteen perches to the eighth line of a Tract of Land made over by Cornelius Carmack to Major Forest Wood then with said Land reverse North sixty four degrees West thirty perches then South forty eight degrees West eighty perches then North thirty two degrees West seventy seven perches then by a straight line to the Beginning containing two hundred and forty one acres more or less  Together with all and singular the houses Buildings Improvements Commissions and Advantages on or to the said Land belonging, or any way appertaining To have and to hold the said Land and Premises aforesaid with the Appurtenances unto them the said Joshua Delaplane and William Pittinger their Heirs Executors Administrators and Assigns forever to them and their own proper use and Behoof, and to no other Use Intent or Purpose whatsoever.  And the said Peter Albaugh for himself his Heirs Executors and Administrators doth covenant promise grant and agree to and with the said Joshua Delaplane and William Pittinger their Heirs Executors Administrators and Assigns by these presents that he the said Peter Albaugh his Heirs Executors Administrators and every of them the Land and premises aforesaid unto the said Joshua Delaplane and William Pittinger their Heirs Executors Administrators and Assigns against all and every person and persons whatsoever shall and will warrant and forever defend Provided always and upon this Condition following to wit that if the said Peter Albaugh his Heirs Executors or Administrators do and shall  well and truly pay,  or cause to be paid unto the said Joshua Delaplane and William Pittinger their costs and attorney Executors Administrators or Assigns the said sum of four hundred and fifty pounds Gold or Silver Currency at or upon the ninth day of August which will happen in the year seventeen hundred and ninety one with legal Interest from the date hereof then this Indenture  to be void and of none effort, but if default be had or made in payment of this said sum of four hundred and fifty pounds Gold or Silver Currency with legal Interest as aforesaid, also the Cost of drawing and recording this Instrument of Writing that then this Indenturs to stand in full force power and virtue in  Law.  In Witness whereof the said Peter Albaugh hath hereunto set his hand and affixed his seal the day and year first written.  Signed sealed} WM Beall                                   Peter Albaugh  (seal)

And delivered in presence of } Jacob Young

On which deed were thus endorsed to wit
Frederick County sct.  On the ninth day of August seventeen hundred and eighty eight Peter Albaugh party to the aforegoing Instrument of Writing came before us the Subscribers two of the Justices of the Peace for said County and acknowledged the same to be his Act and deed, and the Land and Premises within mentioned to be the right and Estate of the within named Joshua Dellaplane and William Pittinger their Heirs Executors Administrators and Assigns forever according to the true Intent and Meaning of this written Instrument of Writing, and this Act of Assembly in such Cases made and provided
