In the Name of God Amen. I Peter Albaugh of Frederick County and State of Maryland being sick yet of perfect and disposing mind and memory - praised be God for it calling to mind the uncertainty of this transitory life and the great propriety of making a deed - arrangement of our personal concerns do make and ordain this my last will and testament. That is to say I recommend my soul into the hands of God who gave it, I also earnestly recommend to my Executor to have my Body Interred after a decent and Christian like manner - and as to the worldly estate where with it hath pleased God to bless one in this world I give and bequeath demise and dispose thereof in manner following Viz. - **Imprimis my will and desire is that my son Peter out of his part of my Estate pay all my just debts and funeral expenses -

Item     I give and devise unto my daughter Sarah sixty acres of my land being part of a Tract called the resurvey on Welch Cabbin lying and being in the county aforesaid beginning for said Sixty acres at the end of the that line agreeable to the platt of said land and running with the fourth line of said tract of land one hundred and four perchs and then run across and into said tract of land so as to lay off on said line as square as the length of said one hundred and four perchs will admit of to make the sixty acres aforesaid

Item     I further give and bequeath unto my daughter Sarah one Bay mare which is now with fole, but the colt when foaled and fit to take from the mare I give and bequeath to my son Peter, I further give and bequeath to my daughter Sarah a white horse colt two years old, two red cows, one red heifer and a small black heifer, one red sow big with piggs, two feather beds and furniture now called hers, the chest that is now called hers and one large iron kettle and one large pewter dish

Item     I give and devise unto my youngest son Peter all the rest of my Estate both real and personal that is to say the remaining part of my tract of land lying and being in Frederick County aforesaid known and distinguished by the resurvey on part of Welch Cabbin except the sixty acres part of which as aforesiad I have devised and given to my said daughter and the articles of my personal estate as above mentioned which I have also given to my said daughter, as to the rest of my children Zachariah, Adam, John, the children of my daughter An, my daughter Catharine, Sarah, Elizabeth and Magdelena all of whom have received their equal proportion of my estate, except my son Zachariah who had received fifty pounds more than his proportion for which sum I hold his bond and which sum and interest agreeable to said bond I give unto my said son Peter the said sum of fifty pounds & interest without being compelled thereto by law, and I do hereby further declare that my sons and daughters and daughters children as above mentioned who have received their proportions of my Estate excepting my son Zachariah who owes me the fifty pounds on the Bond as aforesaid shall by their presents be acquitted and discharged and the said proportions which they have received shall go in full - Satisfaction of all right titles, interest I am and demand whatsoever which they can any way pretend to have or claim of in or to all or any part of my real or personal Estate and Lastly I do hereby constitute and appoint my Dear son Peter Albaugh to be my Sole Executor of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last will and Testament -

In testimony whereof I have hereunto set my hand and affixed my seal this twentieth day of December in the year of our Lord one thousand Eight Hundred and Eight

Signed Sealed Published and Declared by Peter Albaugh the above named Testator and for his last will and Testament in the presence of us who at his request in his presence and in the presence of each other have subscribed our name as witnesses thereto                                                                    Jacob Cookerty, Abraham Renner, Midd. Smith

Frederick County to wit:
         On the 9th day of September 1811 Then came Peter Albaugh and made oath on the Holy Evangels of Almighty God that the foregoing Instrument of writing is the true whole will and testament of Peter Albaugh Senior late of Frederick County deceased that hath come to his hands and possession and that he doth not know of any other                                                                                  Rich. Frederick County to wit:
         On the 9th day of September 1811 then came Jacob Cookerty & Middleton Smith, two of the subscribing witnesses, to the foregoing last will & testament of Peter Albaugh Senior late of Frederick County deceased and made oath on the Holy Evengely of Almighty God that they did see the testator therein named Sign and seal this will that they heard him publish pronounce and declare same to be his last will and testament that at the time of his so doing he was to the best of their apprehension of a sound and disposing mind memory and understanding that they respectively subscribed their names as witnesses to the will in the presence and at the request of the Testator. And that they did also see Abraham Renner the other subscribing witness sign his name as a witness to said will in the presence and at the request of the Testator                                                           Rich. Maryland, SS.

Know all men by these presents that we Peter Albaugh, Abraham Renner and Noah Philips, all of Frederick County are held and firmly bound unto the State of Maryland in the full and just sum of One thousand pounds current money To which payment well and truly to be made and done we bind ourselves and every of us our and every of our heirs Executors and Administrators in the whole and for the whole jointly and severally firmly by those presents sealed with our seals and dated this 28th day of September 1811~~~~

The condition of the above obligation is such that if bound on Peter Albaugh shall well and truly perform the office of Executor of Peter Albaugh, late of Frederick County, deceased according to Law and shall in all respects discharge the duties of him requires by law as Executor aforesaid without any Injury or damage to any person interested in the faithful performance of the said Office whom the above obligation to be void it is otherwise to be and remain in full force and virtue in Law.
