The Last Will and Testament of Nicholas Gutshall Decd
In the name of God, Amen. Be it remembered
that Nicholas Gutshall of the County of Jefferson and State of Ohio being of sound Mind
and memory, knowing the uncertainity of Life as well as the certainity of an approaching
Death, doth constitute this my Last Will and Testament in the way and manor following Viz.
First. I bequeath my soul to God who gave it to
me, hoping and trusting he will raise it up to reign with him and his Christ thro the
annalls of a Blest duration.
Secondly. I give my body to the Earth from
whence it came, to be buried in a palin and decent manner,
Thirdly. That the expenses necessary following the
same be paid out of the monies arising from my Estate
Fourthly. I desire that all my debts be paid
out of monies I may own or profits~
Fifthly. I will and devise unto my wife
Margaret Gutshall my Grist-Mill, *Cornmill, and Horse mill, together with one hundred
acres of land on the east side of Section No. 7 Township 11th. Range 4th to be laid off as
square as will allow (together with a sufficient (up the bottom and Raise) of Land for
the use of the water for said mills and for a water right forever thereunto to belong unto
said mills forever, during her life time, together with all the appertenances and
improvements thereunto belonging, together with one bed and furniture two mill cows, such
of each so it as the said Margaret may chuse, and that at her Death I devise the aforesaid
mills, and lands to be sold at publick auction to the highest bidder, with a sufficiency
of Land up the Bottom and Race for the use of said Mills and conveniency thereunto to the
purchaser forever, and the money to be equally divided amongst my heirs, and the said
Margaret to maintain Daniel and Samuel Gutshall till of age.
Sixthly. I will and devise that the remainder of my
Land and personal property be sold at publick auction, with or without credit (as may be
by my Executors thought most proper) and the money equally divided amongst all my heirs~
Seventhly. I will and devise my trusty Heirs
Jacob Gutshall and John Gutshall to be the Sole and Lawfull Executors of this my Last Will
and Testament with full power to execute the same, Confirming this and this alone.
In witness whereof I have set my hand and seal this twenty seventh day of September in the
year of our Lord, eighteen hundred and seven.

I, Jacob Kiser, Peter France and Maurice Albaugh the subscribing witnesses to the within
Will being duly Sworn and depise and say, that they heard Nicholas Gutshall the testator
within named Sign & Seal the same, and heard him publish, pronounce and declare the
within instrument to be his Last Will and Testament and that the Subscribed their names
thereto in the presence, & at the request of the Testator and in the presence of each
other.~ Sworn in open court the 10th November A.D. 1807.
On the 5th day of April Anno Domini one thousand eight
hundred and eight, The Court Order that this will be admitted to records, & that
Letters Testamentary with a copy thereof annexed be granted to Jacob Gutshall & John
Gutshall the Executors therein named~
