Morris Albaugh to Edward Owings

At the request of Edward Owings the following deed was recorded This Indenture made this thirteenth day of
November in the year of our Lord one thousand eight hundred and four between
Morris Albaugh of Frederick County and State of Maryland of the one part and
Edward Owings of the County and State aforesaid of the other part. Witnesseth
that the said Morris Albaugh for and in consideration of the sum of three
hundred dollars current money of the United States to him in hand paid by the
said Edward Owings at or before the ensealing and delivery of these presents the
receipt whereof is hereby acknowledged he the said Morris Albaugh hath given
granted bargained and sold aliened released enfeoffed and confirmed and by these
presents doth give grant bargain and sell, alien, release, enfeoff and confirm
unto him the said Edward Owings his heirs and assigns forever all that piece
part or parcel of Land and premises situate lying and being in the county and
State aforesaid being part of Lott No. 1 which Number One is part of Monocacy
Manor and which said part or parcel of Land was on or upon the fourth day of
November 1795 conveyed by William Dern to a certain George Albaugh and recorded
in Liber W.R. No. 13 folios 618 & 619 one of the Land records of Frederick
County and was on or about the eighth day of November 1799 conveyed by the said
George Albaugh to Morris Albaugh aforesaid and recorded in Liber W.R. No. 19
folios 115, 116 & 117 also one of the Land records of the county aforesaid
reference being had to the said deeds will more fully appear Beginning for, as
part of said Lot No. 1 at a stone planted at the end of the fifth line said Lott
No. One and running thence with the sixth line thereof as surveyed by George
Dent Esq. In the year one thousand seven hundred and eighty two South eight
degrees East twenty perches to a Stone planted on the north Seventy four degrees
East Line of Monocacy Manor, aforesaid then by and with said line reversed as
surveyed at the time aforesaid South seventy three degrees West eight and a
quarter perches to a stone planted then north four and three quarter degrees
west twenty and a quarter perches to a stone planted on the fifth line of Lott
No. 1 aforesaid then by and with all and singular the houses buildings
Improvements rights members and appurtenances whatsoever to the said piece part
or parcel of Land and premises belonging or in any wise appertaining and all the
Estate Right title property Interest, benefit claim or demand whatsoever in Law
and equity of him the said Morris Albaugh of in and to the within described
piece part or parcel of Land and premises and every part thereof To have and to
hold the said piece part or parcel of Land and premises with the appurtenances
thereunto belonging and every part thereof unto him the said Edward Owings his
heirs and assigns to the only proper use and behoof of him the said Edward
Ownings his heirs and assigns forever and to and for no other use intent or
purpose whatsoever. And he the said Morris Albaugh for himself and his heirs
the aforesaid piece part or parcel of Land and premises with the appurtenances
and every part thereof unto him the said Edward Ownings his heirs and assigned
shall and will warrant and forever defend by those presents from and against all
and every other person or persons claiming any right or title to the same by
from or under him them or any of them and Lastly the said Morris Albaugh and his
heirs shall and will at any time hereafter at the request cost and charge of him
the said Edward Ownings his heirs or assigns execute and acknowledge any other
deed or Instrument of Writing as shall be thought lawfully necessary for the
better granting and conveying in fee simple by like warranty the within piece
part or parcel of Land and promises unto him the said Edward Owings his heirs
and assigns forever according to the true intent and meaning of these presents.
In witness whereof the said Morris Albaugh hath hereunto set his hand and
affixed his seal the day and year first within written. Signed sealed and delivered in presence } State of Maryland Frederick County, to wit,
Morris Albaugh the grantor within named acknowledges the foregoing Instrument of
Writing to be his act and deed and the piece part or parcel of Land therein
mentioned to be the right and estate of Edward Owings grantee therein also named
his heirs and assigns forever according to the purport true intent and meaning
thereof and the acts of assembly in that case made and provided and now at the
same time Catherine Albaugh wife of the said Morris Albaugh being privately
examined out of the hearing of her husband acknowledged the said Instrument of
Writing to be her act and deed and the piece part or parcel of Land and premises
therein mentioned to be the right and estate of the within named Edward Owings
his heirs and assigns forever and being asked whether she doth make her
acknowledgement of the same willingly and freely & without being induced thereto
by fear or threats of, or ill usage by her husband or fear of his displeasure
acknowledges that she doth make her acknowledgment of the same willingly and
freely and within being induced thereto by fear of threats of, or ill usage by
her husband or fear of his displeasure. Taken and certified the day and year
first within written before me the subscriber one of the associate Justices of
Frederick County Court
