DEED   Morris Albaugh and wife To Daniel F. Heastan

 

Know all men by these presents:  That we Morris Albaugh and Elizabeth Albaugh wife of said Morris Albaugh of the County of Harrison and State of Ohio in consideration of the sum of Twelve hundred Dollars to us in hand paid by Daniel F. Heastan of the County ad State aforesaid, the receipt whereof is hereby acknowledged, do hereby Grant, Bargain, Sell and Convey to the said Daniel F. Heastan his heirs and assigns forever, the following Real Estate situated in the County of Harrison in the State of Ohio and in the Steubenville Land District and bounded and described as follows:  Being part of the West half of the Southwest quarter of Section numbered thirteen (13) of Township Thirteen (13) of Range six (6) beginning for the same at the North West corner of said South west quarter thence South 1º West 41.18 perches, thence South 89 º E 78.5 perches, thence North 7º East 41.15 perches to the North east corner of said half quarter  Thence West along North line of said section to the place of beginning Twenty acre be the same more or less.  Also the following tract or parcel of land lying and being in the County of Harrison and State of Ohio and in the Steubenville Land District.  It being that part of the South half of the West half of the north west quarter of Section thirteen (13) of Township thirteen (13) of Range six (6) that lies South of the road that runs through said farm from Hanover in Harrison County Ohio to New Philadelphia in Tuscarawas County Ohio containing one hundred rods more or less
                To have and to hold said premises with all the privileges and appurtenances therewith belonging to the said Daniel F. Heastan his heirs and assigns forever.  And the said Morris Albaugh and Elisabeth Albaugh for themselves and theirs heirs do hereby covenant with the said Daniel F. Heastan his heirs and assigns that they are lawfully seized of the premises aforesaid, that the said premises are Free and clear from all incumbrances whatsoever, and that they will forever warrant and defend the same with the appurtenances and the said Daniel F. Heastan his heirs and assigns against the lawful claims of all persons whomsoever.
                In Witness whereof, the said Morris Albaugh and Elisabeth Albaugh, who hereby release their right of dower in the premises have hereunto set their hand and seal this 1st day of March in the year of our Lord one thousand eight hundred and seventy two.

State of Ohio, Harrison County, SS.
Be it remembered that on this First day of March A.D. 1872 before me, the subscriber, a Justice of the Peace in and for said County, personally came the above named Morris Albaugh and Elisabeth Albaugh his wife the Grantor in the foregoing Deed and acknowledged the signing and sealing of the same to be their voluntary act and deed, for the uses and purposes therein mentioned.  And the said Elisabeth Albaugh, wife of the said Morris Albaugh being at the same time examined by me, separate and apart from her said husband, and the contents of said Instrument being by me made known and explained to her she then declared she did voluntarily sign seal and acknowledge the same, and that she is still satisfied therewith as her voluntary act and deed for the uses and purposes  therein mentioned.
                In Testimony whereof, I have hereunto subscribed my name and affixed my official seal on the day and year last aforesaid W.B. Johnston, Justice of the Peace.  I hereby certify that the Deed of which the foregoing  is a copy had adhesive stamps attached to the value of one dollar and fifty cents which were duly cancelled according to law.  I further certify that said Deed was entered for record June 17th 1872 and Recorded July 5th 1872.
