Wm J Miser to Levi Albaugh

This Indenture made this eighteenth day of October in the year of our Lord one thousand eight hundred and thirty eight between William J. Miser and Jane his wife of the County of Jefferson in the State of Ohio of the one part and Levi Albaugh of the County of Harrison and State aforesaid of the other part.  Witnesseth that the said William J, Miser and Jane his wife for and in consideration of the just sum of eight hundred dollars to them in hand paid the receipt whereof they do hereby acknowledge have given, granted, bargained, sold, released and conveyed and do by these presents give, grant, bargain, sell, release convey and confirm unto the said Levi Albaugh and his heirs and assigns forever all that tract or parcel of land situate and being in the County of Harrison in the State of Ohio it being a part of the East half of the north East quarter of Section Eighteen in township ten of Range four in the district of Steubenville Ohio containing seventy five acres more or less to have and to hold the premises aforesaid with all the privileges and appurtenances thereunto belonging or in anywise appertaining unto him the said Levi Albaugh and unto his heirs and assigns forever and the said William Miser and Jane his wife for themselves and for their heirs, executors & administrators covenant and promise to and with the said Levi Albaugh his heirs and assigns that they the said William J. Miser and Jane his wife are lawfully seized of the premises aforesaid and that the premises are free and clear of and from all incumbrances whatsoever and further that they the said William J. Miser and Jane his wife will well and truly warrant and forever defend the premises and hereby grant unto the said Levi Albaugh and to his heirs and assigns against the lawful claims and demands of all and every person whomsoever.  In testimony whereof the said William J. Miser and Jane his wife party of the first part have hereunto set their hands and seals the day and year first above written , signed sealed and delivered in the presence of A. Patterson Mahlen A. Boyd

State of Ohio        }   On the Eighteenth day of October in the year of our Lord one thousand eight
Harrison County    }   hundred thirty eight before the subscriber an aforesaid Judge within and for
                                said County personally appeared the said William J. Miser and Jane Miser who
signed and sealed the foregoing deed and acknowledged the signing and sealing thereof to be their
act and deed for the purpose therein expressed and the said Jane Miser wife of the said William J.
Miser being by me examined separate and apart from her said husband and the contents of said
deed being fully made known to her by reading the same in her presence she did declare upon such
separate examination that she did voluntarily sign seal and acknowledge the same and that she is
still satisfied therewith given under my hand and seal the day and year aforesaid.
