Daniel Miller to John Albaugh

Know all men by these presents that we
Daniel Miller and Susanna Miller wife of said Daniel Miller of Harrison County
and State of Ohio in consideration of the sum of two thousand five hundred
dollars in hand paid by John Albaugh of Carroll County and State aforesaid have
bargained and sold and do hereby grant bargain sell and convey unto the said
John Albaugh his heirs and assigns forever the following premises situate in the
County of Harrison in the State of Ohio being the South west quarter of Section
number three of Township number twelve of Range number five of the lands in the
Steubenville District containing one hundred and sixty acres more or less. To
have and to hold said premises with the appurtenances unto the said John Albaugh
hi heirs and assigns that he is lawfully seized of the premises aforesaid that
the premises are free and clear of all encumbrances whatsoever and that he will
forever warrant and defend the same with the appurtenances unto the said John
Albaugh his heirs and assigns against the lawful claims and demands of all
persons whomsoever. In testimony whereof the said Daniel Miller & Susanna
Miller have hereunto set their hands and seals this third day of September in
the year of our Lord one thousand eight hundred and forty
nine. The State of Ohio, Harrison County SS. Before me Andrew Lynch, a Justice of the Peace in and for said County personally appeared the within named Daniel Miller and Susanna his wife and acknowledged the signing and sealing of the within conveyance to be their voluntary act and deed and the said Susanna being at the same examined by me separate and apart from her said husband and the contents of said instrument made known to her by me she then declared that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith this 9th day of September A.D. 1849.
