Maurice Albaugh to William Albaugh

 

This Indenture made this thirteenth day of August in the year of our Lord one thousand eight hundred and twenty four between Maurice Albaugh and Catharine his wife of the County of Harrison and State of Ohio of the first part and William Albaugh of the County and State aforesaid of the second part Witnesseth, that the  said party of the first party of the first part for and in consideration of the sum of two hundred and Ninety seven dollars to them in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold and by these presents do grant bargain sell convey and confirm unto the said party of the second part his heirs or assigns all the following described tract of Land and premises with the appurtenances, situate, lying and being in the County and State aforesaid and is bounded as follows viz.  Beginning at the North East corner of the South East quarter of Section Number Eighteen in the Township Number twelve in Range Number five and running thence West to the North West corner of said quarter.  Thence South to George Albaughs’ corner.  Thence East with his line to the East boundary line of said  quarter also corner to George Albaugh.  Thence North along said line to the place of beginning containing Ninety nine acres more or less.  To have and to hold the above described tract and parcel of Land and premises with the appurtenances to the said party of the second part his heirs or assigns, to the only proper use and behoof of him the said party of the second part his heirs or assigns forever.  And the said party of the first part for themselves, their heirs, Executors or Administrators doth hereby covenant and agree to and with the said party of the first part his heirs or assigns, that they the said party of the first part, the above described tract and parcel of Land and premises to the said party of the second part and will warrant and forever defend against all persons and claims whatsoever.  In Testimony whereof the said party of the first part have hereunto set theirs hands and seals on the day and date above written.

State of Ohio, Jefferson County  SS       Before me John Shober, a Justice of the Peace in and for said       County personally came the within named Maurice Albaugh and Catharine his wife and acknowledged the within Instrument of Writing to be their voluntary act and Deed for the purpose therein contained.  And she the said Catharine being by me examined separate and apart from her said husband and did declare that she signed and as her act and Deed delivered the same without the coercion or compulsion from her husband.  Witnesseth my hand and seal this 18th day of August A.D. 1824.
