Mathias Allaback to Donald Davidson
This Indenture, made this fourth day of
March in the year of our Lord 1837 by & between Mathias Allaback & Sally his
wife of the County of Jefferson in the State of Ohio of the one part, and Donald
Davidson of the County of Columbiana and Stat aforesaid of the other part.
Witnesseth that the said Matthias Allaback and Sally his wife for and in
consideration of the just sum of Two hundred and seventy five dollars to them in
hand paid in receipt whereof they do hereby acknowledge have given, granted,
bargained and sold and do by these presents give, grant, bargain, sell unto the
said Donald Davidson and his heirs and assigns forever all that tract or lot of
land situate and being in the County of Jefferson in the State aforesaid and
being a part of Section No. Twenty, Township No. Nine, of Range No. Two of the
United States land sold at the land office in the Town of Steubenville in the
State aforesaid. Beginning at the South East corner of Wm. Hamilton’s land,
thence South eight five perches to a post, thence West one hundred and twenty
two & two tenths perches to a post, then North fifty seven and eight tenths
perches to a post, then north sixty four and one fourth degrees East eighty two
and eight tenths perches to a post, then south eighty degrees East forty eight
and two tenth perches to the place of beginning containing Sixty one and three
fourth of an acre be the same more or less.
To have and to hold the premises aforesaid with all the privileges and
appurtenances thereunto belonging or in anywise appertaining unto him the said
Donald Davidson and unto his heirs and assigns executors and administrators,
covenant and promise to and with the said Donald Davidson his heirs and assigns,
that they the said Mathias Allaback and Sally his wife are lawfully seized of
the premises aforesaid, that they have good right and lawful authority to sell
the same in manner aforesaid, and that the premises are free and clear of and
from all incumbrances whatsoever. And further that they the said Mathias and
Sally his wife will well and truly warrant and forever defend the premises
herein and hereby granted unto the said Donald Davidson and to his heirs and
assigns against the lawful claims and demands of all and every person
whomsoever.
In Testimony whereof the said Mathias Allaback and Sally his
wife, party of the first part have hereunto set their hands and seals the day
and year above written.

THE STATE OF OHIO
JEFFERSON COUNTY SS.
(SEAL) On the 4th day of March A.D. 1837 before the Subscriber a
Justice of the Peace within and for said County personally appeared the said
Mathias Allaback and Sally Allaback who signed and sealed the foregoing deed and
acknowledged the signing and sealing thereof to be their act and deed for the
purpose therein expressed. And the said Sally Allaback wife of the said Mathias
Allaback being by me examined and apart from her said husband, and the contents
of said Deed being fully made known to her by reading the same in her presence,
she did declare upon such “separate” examination that she did voluntarily sign,
seal and acknowledge the same & that she is still satisfied therewith. Given
under my hand and seal this date above.
