Maurris Allbaugh to Robert Markley

 

This Indenture made this Sixteenth day of June in the year of our Lord one thousand eight hundred and thirty two between Maurris Allbaugh Junior of Harrison County and State of Ohio and Elizabeth his wife of the first part and Robert Markley of the County and State of the aforesaid of the other part.  Witnesseth, that the above said Maurris Allbaugh Junior and Elizabeth his  wife for and in consideration of the sum of  four hundred dollars to them in hand paid the receipt whereof is hereby acknowledged has granted, bargained and sold, and by these presents doth grant, bargain, sell, convey and confirm unto the said Robert Markley the following described tract of land and premises with the appurtenances thereunto belonging situate lying and being in the County of Harrison and State of Ohio, being the East half of the South East quarter of Section twenty three, in Township twelve and Range five in the district of lands offered for sale at Steubenville Ohio containing eighty acres and seventy five hundredths of an acres according to the official Plat of the surveyor of the said lands returned to General Land officially the Surveyor General, which said tract has been purchased by the said Maurrice Albough senior.  Now know ye that the said Maurrice Allbough and Elizabeth his wife for and in consideration of the sum of four hundred dollars to them in hand paid the receipt is hereby acknowledged hath bargained and sold and by these presents doth sell, convey and confirm unto the said Robert Markley  his heirs, Executors and administrators.  To have and to hold the above described tract of land and premises with the appurtenances to the only proper use , benefit and behoof of him the said Robert Markley his heirs and assigns forever.  And the said Maurrice Allbaugh and Elizabeth his wife for themselves their heirs, Executors or administrators do hereby covenant and agree to and with the said Robert Markley his heirs and assigns that he the said Maurrice Allbaugh and Elizabeth his wife the above described tract of land and premises to the said Robert Markley his heirs and assigns, shall and will forever warrant & defend against all lawful claims whatsoever.  In Testimony whereof the said Maurrice Allbough & Elizabeth have hereunto set there hands and seals on the day and date above  written.

Personally came before me the subscriber, a Justice of the Peace in and for said County the above named Maurice Allbaugh and Elisabeth his wife and acknowledged the signing and sealing of the above instrument of writing to be their act and deed for the purpose therein contained and directed it to be recorded as such, the said Elisabeth his wife being by me examined separate and apart from he husband said she signed the same without fear or coercion from her said husband, being myself satisfied that they who signed said instrument are the same persons  whom they present themselves to be.
