James R. Mansfield to Harrison W. Albaugh

 

Know all men by these presents that James R. Mansfield and Lizzie his wife of the county of Jefferson and State of Ohio in consideration of the sum of Six hundred and sixteen and 25/100 dollars to them paid by Harrison W. Albaugh of the State and County aforesaid the receipt whereof is hereby acknowledged do hereby grant, bargain, sell and convey to the said Harrison W. Albaugh his heirs and assigns forever the following Real Estate situate in the County of Jefferson in the State of Ohio and in the Township of Wayne, in said County and bounded and described as follows, viz
          Being in the south east corner of the North east quarter of Section (22) Township (9) Range (3) commencing for said Survey at a stone standing in the east boundry line of Section (22) and being the original half mile corner between Section No. (16 & 22) and running thence as follows to wit:  North 1¼º East, 40 4/10 perches to a stone in the centre of the Road a White Oak 30 inches diameter N 1¼º E 57 Links South 67¼º W 18 perches to a post in the centre of the State Road S 37¾º W 18 5/10 perches to the NE corner of the Grave Yard Lot. S 35¼º W 17 perches to the SE corner of the Grave Yard Lot.  S 35½º W 3 2/10 perches to a post in the quarter section line also corner to Wm M. Blackburn’s  Lot South 88º E 39 7/10 perches to the place of Beginning containing Six (6) acres and twenty six perches.  To Have and to hold said premises with all the privileges and appurtenances thereunto belonging to the said Harrison W. Albaugh his heirs and assigns forever and the said James R. Mansfield for himself and his heirs does hereby covenant with the said Harrison W. Albaugh his heirs and assigns that he is lawfully seized of the premises aforesaid that the premises are free and clear from all incumbrances whatsoever and that he will forever Warrant and Defend the same with the appurtenances unto the said Harrison W. Albaugh his heirs and assigns against the lawful claims of all persons whomsoever.
          In witness whereof the said James R. Mansfield and Lizzie his wife who hereby relinquish her right of Dower in the premises have hereunto set their hands and seals this fourth day of June in the year of our Lord one thousand eight hundred and sixty eight.

Be it remembered that on this fourth day of June AD 1868 before me the subscriber a Justice of the Peace, in and for said County personally came the above named James R. Mansfield & Lizzie his wife the grantor in the foregoing deed and acknowledged the signing and sealing of the same to be their voluntary act and deed for  the uses and purposes therein mentioned and the said Lizzie “Mansfield”, wife of the said James R. Mansfield being at the same time examined by me, separate and apart from her said husband and the contents of said instrument being by me made known and explained to her, she then declared that she did voluntarily sign seal and acknowledge the same and that she still satisfied therewith as her voluntary act and deed for the uses and purposes therein mentioned.
        In Testimony whereof I have hereunto subscribed my name and affixed my hand & seal on the day and year last aforesaid.
