Levi Albaugh to William J. Meiser

This Indenture made this eighteenth day of October, in the year of our Lord one thousand eight hundred and thirty eight, by and between Levi Albaugh and Sarah, his wife, of the County of Harrison in the State of Ohio, of the one part and William J. Miser of the County of Jefferson and State aforesaid of the other part.  Witnesseth that the said Levi Albaugh and Sarah, his wife, for and in consideration of the just sum of six hundred dollars to them in hand paid, the receipt whereof they do hereby acknowledge have given, granted, bargained, sold, released and conveyed and do by these presents give, grant, bargain, sell, release, convey and confirm unto the said William J. Miser and his heirs and assigns forever the following described in lot of land with the appurtenances, situate, lying and being in the County of Jefferson and State of Ohio, and is bounded as follows to wit: on the South side of Market Street in the Town of Annapolis, County of Jefferson and State aforesaid and marked on the plot of said Town and numbered fifty six containing in front on said Market Street, sixty feet and in length or depth one hundred and thirty two feet also fifteen feet off of the east side of lot numbered fifty eight the same being bounded north by Market Street south by Second Street and west by the aforesaid lot number fifty eight in the Town of Annapolis, County and State aforesaid containing in front on said Market Street fifteen feet and in length or depth one hundred and thirty feet.

                To have and to hold the above described In Lot and premises with all appurtenances thereunto belonging or in anywise appertaining, and also the above described fifteen feet of Lot Number Fifty Eight with all privileges and appurtenances thereunto belonging or in anywise appertaining unto him the said William Miser and unto his heirs and assigns forever.  And the said Levi Albaugh and Sarah, his wife, for themselves and their heirs, executors and administrators, covenant and promise to and with the said William J. Miser, his heirs and assigns that they the said Levi Albaugh and Sarah, his wife, are lawfully seized of the premises aforesaid, that they have good right and lawful authority to sell and convey the same in manner aforesaid, and that the premises are free and clear of and from all incumbrances whatever.  And further, that the said Levi Albaugh, and Sarah his wife will well and truly warrant and forever defend the premises herein and hereby granted unto the said William J. Miser and to his heirs and assigns against the lawful claims and demands of all and every person whomsoever.

                In Testimony whereof the Levi Albaugh and Sarah, his wife, party of the first part, have hereunto set their hands and seals the day and year first above written.

(SEAL)   On the eighteenth day of October, in the year of our Lord one thousand eight hundred and thirty eight before the subscriber, a Justice of the Peace within and for said County, personally appeared the said Levi Albaugh and Sarah Albaugh, who signed and sealed the foregoing deed and acknowledged the signing and sealing thereof to be their act and deed for the purpose therein expressed.  And the said Sarah Albaugh, wife of the said Levi Albaugh, being by me examined separate and apart from her said husband and the contents of said deed being fully made known to her by reading the same in her presence, she did declare upon such separate examination that she did voluntarily sign, seal and acknowledge the same and that she is still satisfied therewith.  Given under my hand and seal the day and year aforesaid.
