Land Resurvey Agreement
Land Records, Frederick MD At the request of Doctr Upton Scott and others the following Agreement Was recorded 9th May 1794, to wit ~~ Whereas William Genworthy Jr hath lately run out the lines of a Tract of Land called Runny Mede and some other Lands adjoining (the property of Doctor Upton Scott of the City of Annapolis) with care and accuracy insomuch that the Boundaries ascertained by said running are much to our satisfaction. We the Subscribers do therefore jointly and severally agree and engage on behalf of ourselves our Heirs and all claiming under us that in order to perpetuate said lines and prevent all disputes which might otherwise hereafter arise the lines shall be fairly marked out and Stones erected at the respective Corners with proper inscriptions thereon where necessary - And whereas the aforesaid Doctor Upton Scott has obtained a Special Warrant of Resurvey to resurvey and include the aforesaid Tract called Runny Mede and his several other Lands contiguous thereto in one Tract, and in the Certificate and Patent therefore to have Calls inserted to all such Boundaries as shall be set up, or have already been erected agreeably to the Running done as aforesaid, that the same may be conclusive evidence of the location thereof. We whose names are hereunto subscribed and Seals affixed as adjoining parties and interested in establishing the lines of the lands which are to be included in said Resurvey do jointly and severally with the aforesaid Doctor Upton Scott bind ourselves our Heirs and all claiming under us in the usual sum of two hundred pounds current money to abide by the lines as run as aforesaid and that the Certificate and Patent proposed to be made out and obtained in consequence of the aforesaid Warrant of Resurvey shall be to all Intents and Purposes a full perfect and decisive evidence of the lines and limits hereby intended to be established and as a Testimony of our appreciation thereof we have severally set our Hands and affixed our Seals this fourteenth day of November in the year of our Lord one thousand and seven hundred and ninety three … 1793 U. Henworthy DJH Hugh Ried I do hereby agree and consent that my Tract of Land called Frog Meadow shall be surveyed with two and a half degrees allowance for variation in preference to receiving the same by Course and Distance that Doctor Upton Scott may include in his resurvey supposed to be called Runny Mede enlarged my vacant land adjoining the same and where any of the lines of my said Tract called Frog Meadow are joined by said resurvey I do agree and engage on behalf of myself and my heirs and all claiming under me that such lines shall be marked and bounded by stones set where necessary to be *ei*etual agreeable to Act of Assembly.
