John Albaugh to Thomas Carr

                                 At the request of Thomas Carr the following Deed was recorded                  
                                 The 17th day of May 1798, to wit ~~

This Indenture made this sixteenth day of April in the year of our Lord seventeen hundred and ninety eight Between John Albaugh of Frederick County and State of Maryland of the one part and Thomas Carr of the same County and State aforesaid of the other part.  Witnesseth that the said John Albaugh for and in consideration of the sum of Forty pounds current money to him in hand paid by the said Thomas Carr the receipt whereof the said John Albaugh Doth hereby acknowledge and himself therewith to be fully satisfied Contented and paid and for and in Consideration of the yearly rent of seven shillings and a six pence current  money to be paid to Richard Coale or his heirs executors and Assigns on twenty second day of June yearly and every year her after forever.  Hath given granted bargained sold aliened released and confirmed and by these presents doth give grant bargain sell alien release and confirm unto him the said Thomas Carr his heirs and assigns forever.  All his the said John Albaugh Right, title, interest and property of in and to all the following Lott of ground in the Town of Liberty lying and being in Frederick county aforesaid on a draught of Linganore called Piney Run being part of a tract of land called Dukes Woods it being Numbered Seventy Five of the aforesaid Town Lotts.  Beginning at a stone not up on the north side of the main street of the said town and marked TS No. 75 and running thence north four degrees West three hundred feet then south eighty six degrees west fifty feet then South four degrees East three hundred feet then by a straight line to the Beginning, containing and laid out for one of the aforesaid Town Lotts.  Together with all and singular the buildings and all the premises and appurtenances to the said Lott of Ground belonging or in any wise appertaining therewith belonging unto him the said Thomas Carr his heirs and assigns forever.  On the conditions above mentioned to the only proper use and behoof of him the said Thomas Carr his heirs and assigns and to no other intent or purpose whatsoever.  And the said John Albaugh for himself and his heirs doth hereby covenant promise grant and agree to and with the said Thomas Carr his heirs and assigns that he the said John Albaugh and his heirs shall from time to time and at all times forever hereafter warrant and defend the said Lott of ground and premises with its appurtenances against all manner of persons claiming any right, title,  interest or property unto the said Lot of ground and premises with its appurtenances from by and under him the said John Albaugh and his heirs and the said John Albaugh doth further covenant for himself and his heirs to and with the said Thomas Carr his heirs and assigns that he the said John Albaugh, his heirs shall and will from time to time and at all times forever hereafter at the proper cost and charges of him the said Thomas Carr his heirs or assigns do make acknowledge suffer execute or cause to be made done acknowledged suffered executed all and every such further and other act of acts, thing or things, assurances or conveyances in the Law as by the said Thomas Carr his heirs or assigns or his or their council learned in the Law shall be reasonably devised advised or requested for the further and better assurances and sure making of all and singular the hereby bargained and sold or intended to be herby bargained and sold according to the true intent and meaning of these presents.  In Witness whereof the said John Albaugh hath hereunto set his hand and affixed his seal the day and year above written.                                                                          Jonnah Allbaugh  (seal)

On the 16 day of April 1798 Came the within named John Albaugh before us two of the justices of the Peace for Frederick County and acknowledged the within Deed or Instrument of writing to be his act and Deed and the Lott and Premises herein mentioned to be the right and estate of the within named Thomas Carr his heirs and assigns forever according to Law.  At the same time came Mary Albaugh wife of the said John Albaugh and being by us privately examined from and out of the hearing of her said husband and acknowledged her right and dower in the within Lott of ground and premises to be the right of the aforesaid Thomas Carr his heirs and assigns forever and that she did the same voluntarily without being induced thereto by fear or threats or ill usage from her said husband or fear of his displeasure.
