John Albaugh to Peter Smith

Excd, delvd  27th Septr 1810                       At the request of Peter Smith the following deed is recorded
                                                                8th May 1810, to wit~

This Indenture made this Twenty third day of April in the year Eighteen hundred and ten between John Albaugh and Mary Albaugh his wife of Frederick County and State of Maryland of the one part and Peter Smith of the same county and State of the other part.  Witnesseth that the said John Albaugh and Mary Albaugh for and in consideration of the sum of two hundred dollars to them in hand paid by the said Peter Smith the receipt whereof they the said John Albaugh and Mary Albaugh do hereby acknowledge have given, granted, bargained and sold aliened enfeoffed and confirmed by these presents they the said John Albaugh and Mary Albaugh do give grant bargain and sell alien enfeoff and confirm unto the said Peter Smith his heirs and assigns forever all their right Title Interest claim & demand whatsoever either in Law or Equity of in & to the three following Tracts of Land lying in Frederick County aforesaid they being entitled to the one tenth share or part of said Lands the first Tract or parcel of Land being called Kendricks first choice and containing one hundred acres of land more or less The second Tract or parcel of Land being part of a Tract of Land called Middle Plantation containing twenty acres of land more or less, the third Tract or parcel of Land being part of a Tract of Land called the resurvey on Inclosure containing thirty eight acres and three quarters more or less Together with all and singular the Improvements and advantages to the same belonging or in anywise appertaining and the reversion and reversions, remainder and remainders rents issues & profits rights and estate whatsoever of them the said John Albaugh and Mary Albaugh both in law or Equity as Heirs or devices of the late Adam Smith the father of the said Mary Albaugh or any other Right they may have of in & to the said Lands  & premises.  To have and to hold the aforesaid lands & premises with the appurtenances unto the said Peter Smith his heirs & assigns forever to the only proper use & behoof of the said Peter Smith his heirs and assigns & to or for no other use Intent or purpose whatsoever and the said grantors do hereby covenant to warrant and defend the said Lands and premises against all persons claiming by from or under them and also that they will at any time hereafter at the reasonable request & costs of the said Peter Smith execute and acknowledge any other Instrument of writing to convey all their Right & Title of in and to said Lands to the said Peter Smith in case this is insufficient.  In witness whereof the said John Albaugh and Mary Albaugh have hereunto set their hand & seals the day and year first above written. ~~

Which is thus endorsed, to wit ~~
On the 23rd day of April 1810, the within named John Albaugh & Mary Albaugh came before us two Justices of the Peace in & for Frederick County & State of Maryland and acknowledged the afore going Instrument of writing to be their and each of their respective act & deed and the Lands & premises therein  mentioned to be the right  Title & Estate of the within named Peter Smith his heirs and assigns forever and the said Mary Albaugh wife of John Albaugh being by us privately examined apart from and out of the hearing of her said husband acknowledged that she made this her acknowledgement willingly and freely without being induced there to by fear or threats of or ill usage by her husband or through fear of his displeasure.
