John Allaback to Mary Leonard

This Indenture made and entered into that Seventeenth day of February in the year of our Lord one thousand eight hundred and fifty seven by and between John Allaback and Nancy his wife of the County of Jefferson and State of Ohio of the one part and Mary Leonard of the County and State aforesaid of the other part  Witnesseth that the said John Allaback and Nancy his wife for and in consideration of the just sum of Four hundred and fifty dollars to them in hand paid the receipt whereof they do hereby acknowledge have granted bargained sold and conveyed and by these presents do grant bargain sell convey and confirm unto the said Mary Leonard and her heirs and assigns forever the following premises situate in the County of Jefferson and State of Ohio and described as follows namely Being a part of Lot number Four in Shelley addition to the Town of Richmond and bounded as follows namely fronting on Main Street thirty feet and in Lisbon Street one hundred and Sixty four feet and in the alley Sixty feet thence with Lot number three to main street it being the same deeded to John Allaback by Thompson Douglass deed bearing date the twelfth day of June one thousand eight hundred and fifty four.  To have and to hold the premises aforesaid with all the privileges and appurtenances thereunto belonging unto her the said Mary Leonard and her heirs and assigns forever.  And the said John Allaback and Nancy his wife for themselves and for their heirs executors and administrators covenant and promise to and with the said Mary Leonard her heirs and assigns that they the said John Allaback and Nancy his wife are lawfully seized of the premises aforesaid that they have good right and lawful authority to sell and convey the same in manner aforesaid and that the premises are free from all incumbrances whatever and further that they the said John Allaback and Nancy his wife will well and truly warrant and forever defend the premises herein and hereby granted unto the said Mary Leonard and her heirs and assigns against the lawful claims and demands of all and every person whomsoever.  In Testimony whereof the said John Allaback and Nancy his wife have hereunto set their hands and seals the day and year first above written.

The State of Ohio, Jefferson County, SS.
Before the subscriber, a Justice of the peace in and for said County personally appeared the above named John Allaback and Nancy his wife and acknowledged the signing and sealing of the foregoing conveyance to be their voluntary act and deed and the said Nancy Allaback being by me examined separate and apart from her husband and the contents of said instrument made known to her by reading the same in her presence she did declare upon such separate examination the she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith.  February seventeenth one thousand eight hundred and fifty seven.                                                                   A.J.
