John Albaugh to Peter Fox

Executed Granted      }           At the request of Peter Fox the following deed was recorded
4 May 1797                }          31st August 1795, to wit ~~

This Indenture made this twentieth day of August one thousand seven hundred and ninety five Between John Albaugh of Frederick County and State of Maryland of the one part and Peter Fox of the same County and State of the other part    Witnesseth that the said John Albaugh for and in Consideration of the sum of one hundred and twenty five pounds current money to him in hand paid the receipt he doth hereby acknowledge and himself to be therewith fully satisfied and contented  hath given granted bargained sold aliened enfeoffed and confirmed and by these presents doth give grant bargain sell alien enfeoff and confirm  unto the said Peter Fox and his heirs All that Lot of Ground lying in Liberty Town in the County and State aforesaid being Number 30 as distinguished on the plan or plat of the said Town  Beginning for the said Lot of Ground at a stone marked AL standing on the South side of the Main Street and running thence South four degrees East three hundred – then South eighty six degrees West fifty feet then North four degrees West three hundred feet then with a straight line to the place beginning containing a Lot of Liberty Town aforesaid according to the plan or plot of the said Town, and all and singular the houses Gardens Fences and Improvements to the same belonging or in any wise appertaining, and also the revision and revisions remainder and remainders Right Estate Interest Benefit Claim and Demand whatsoever of him the said John Albaugh his heirs and Assigns of in and to all and singular the premises with their and so any of their Appurtenances and of in and to every part and parcel of them  To have and to hold the said bargained Lot and premises with its Appurtenances unto the said Peter Fox his heirs and assigns forever to the only Use and Behoof of him the said Peter Fox his heirs and assigns ~~  And the said John Albaugh for himself and his heirs the said Lot and premises with its and every of its appurtenances unto the said Peter Fox his heirs and assigns against him the said John Albaugh his heirs and assigns  and all persons claiming by from or under him their or any of them will warrant and defend ~~  provided nevertheless and it is covenanted and agreed by and between the parties for themselves their Heirs and assigns that the said Peter Fox his heirs and assigns shall from time to time and at all times when the same shall become due after the present year ending 22nd day of June pay or cause to be paid to the proprietor or proprietors of the said Town for the time being the custom ground rent which by a release made the said Lot is and may be subject to, any thing or Clause herein contained to the Contrary notwithstanding.  In Witness whereof the parties have interchangeably set their Hands and Seals the day and year first above written.

On the 20th day of August 1795 came the within named John Albaugh before us two Justices of the Peace of Frederick County and acknowledged the within deed to be his Act and Deed, and the Lot and premises therein mentioned to be the Right and Estate of the within named Peter Fox his heirs and assigns forever.  At the same time came Mary wife of the said John Albaugh before us and being privately examined apart from and out of the hearing of her said husband declared that she relinquished her Right of Dower in the within Lot and premises and that she did the same freely & voluntarily without being induced thereto by fear or threats of ill usage by her said husband or for fear of his displeasure.
