John Albaugh to Daniel Albaugh
Examined and delivered At the request of Daniel Albaugh the following deed was
Granted 16th July 1805 recorded the 31st day of March 1804 to wit ~~
This Indenture made this thirtieth day of January in the year of our Lord one thousand eight hundred and four.
Between John Albaugh senior of Frederick County and Sate of Maryland of the one part and Daniel Albaugh son
of the said John Albaugh of the same county and State aforesaid of the other part Witnesseth that the said John
Albaugh for and in consideration of the sum of four hundred and fifty dollars current money to him in hand paid
by the said Daniel Albaugh at and before the ensealing and delivery of these presents, the receipt whereof he the
said John Albaugh doth hereby acknowledge and himself therewith to be fully satisfied and paid. Hath given granted
bargained and by these presents doth give grant bargain and sell unto the aforesaid Daniel Albaugh his heirs and
assigns All that parcel of Land being part of a Tract of Land called Chesnut Levell’s situate in the County aforesaid.
Beginning for the part hereby bargained and sold at a Stone planted at the end of the sixteenth line of said
Land called Chesnut Levells and running thence with the tenth Line of a Tract of Land called the "Crooked Stripe " South
seventy nine and a half degrees West fifty four perches to a stone at the end of the sixth Line of a Tract of Land called
Albaugh's Choice granted Zachariah Albaugh the eleventh day of August one thousand seven hundred fifty three for
one hundred and twenty five acres and with it reversed North sixty seven degrees West ninety six perches to a stone
then north thirteen degrees East sixty eight perches to a Stone south eighty eight and a quarter degrees East one hundred
and twenty eight and a quarter perches to a marked black Oak Sapling Standing on the sixteenth line of the aforesaid Land
called Chesnut Levells then with said sixteenth line thereof South eighty nine and a half perches to the first beginning
containing seventy five acres of Land more or less. Together with all and singular the Improvements & advantages with
the appurtenances to the above described parcel of Land belonging or in any wise appertaining. To have and to hold the
said parcel of Land with the appurtenances unto him the said Daniel Albaugh his heirs and assigns to the only proper use
and behoof of the said Daniel Albaugh his heirs and assigns forever. And the said John Albaugh for himself and his heirs
the said parcel of Land and premises and every part thereof against him the said John Albaugh and his heirs and against
all and every other person or persons whatsoever claiming or to claim by from or under him them or any of them to the said
Daniel Albaugh his heirs and assigns shall and will warrant and forever defend by these presents. In witness whereof the
aforesaid John Albaugh hath hereunto set his hand and affixed his seal the day and year first above written.

Frederick County Sct On the thirtieth day of January 1804 came the within named John Albaugh before us the subscribers
two Justices of the peace for the county aforesaid and acknowledged the within Instrument of writing to be his act and deed
and the parcel of Land and premises therein mentioned & described to be the right and Estate of the within named Daniel
Albaugh his heirs and assigns forever according to the true intent and meaning of the said deed and the acts of assembly
in such case made and provided. At the same time came Catherine wife of the said John Albaugh and relinquished her right
of dower in the parcel of Land within mentioned to the said Daniel Albaugh his heirs and assigns forever she being by us
Examined apart and out of the hearing of her said husband declared that she did the same of her own free and voluntary
consent and that she was not induced thereto by threats or through fear of gaining the displeasure of her said husband
