In the name of God Amen, I John Aulabaugh of Conawago Township, in the County of Adams and State of Pennsylvania, being in a declining State of health in body, but of a Sound Memory and understanding, Blessed be Almighty God for the same, considering the uncertainty of this transitory life, do make and publish this my last Will and Testament in manner and form following viz. principally and first of all, I command my immortal Soul into the hands of Almighty God who gave it hoping through our Lord and Savior Jesus Christ to receive a pardon and forgiveness of all my Sins, and my body I commend to the earth to be buried in a decent and Christian like manner at the discretion of my Executors herein after named and as to such worldly estate herewith it hath pleased God to bless me with in this life I give and devise as follows first I direct that all my just debts and funeral expenses be first paid by my executors out of my estate.

Item I give and devise unto my Wife Mary all my real and personal estate during her mortal life or widowhood, if she pays all my just debts and funeral expenses and gives as much house furniture to my two Daughters Catharine and Louisa as each of my other three daughters got, but if she be not able to pay my just debts and to give the outfit to my said two daughters, She may by the consent of my executor sell all or any part of my estate to enable her to do so and whereas I have advanced one hundred and sixty dollars to my son John for which I have his note, on which no interest shall be counted, and I have also advanced to my daughter Harriet seventy dollars for which I have a note of her husband John G. Morningstar and I have advanced one hundred dollars to my daughter Polly for which I have her husband Jacob Diehl note, no interest shall be counted on said notes.

Item. My Will is that on the death or marriage of my said Wife, all my Real, personal & mixed estate shall be sold at public sale for the best price that can be gotten by my Executor, and the money arising there from to be divided among my nine children as follows, two hundred and sixty dollars to my son John, two hundred and sixty dollars to my son Absalom, two hundred and sixty dollars to my son Jeremiah, two hundred and sixty dollars to my son Zephaniah, one hundred dollars to my Daughter Harriet, one hundred dollars to my daughter Polly, one hundred dollars to my daughter Eliza, one hundred dollars to my Daughter Catharine, one hundred dollars to my Daughter Louisa, and the remainder of my estate to be all equally divided among my nine children in Share and Share alike, one equal share thereof to my Son John, one equal share to my Son Absalom, one equal share to my Son Jeremiah, one equal share to my Son Zephaniah, one equal share to my Daughter Harriet, one equal share to my Daughter Polly, one equal share to my Daughter Eliza, one equal share to my Daughter Catharine, one equal share to my daughter Louisa, and thereas I have the ground rent of one Lot in McSherrystown, in the possession of John Busley Esq. at persons paying one dollar and thirty three cents yearly, which ground rent I give to my son Jeremiah to him his hiers and assigns forever. And lastly I nominate and appoint my Son John, my son Absalom and my son Jeremiah to be executors of this my last Will and Testament giving and granting them full power to sell and convey my Land to the purchaser or purchasers by Deed as fully and totally as I myself could do at the execution hereof, In Witness thereof I have hereunto Let my hand and Seal the 27th day of April, in the year of our Lord one thousand eight hundred and forty three.

Before me Wm. King Register for the probate of Will & granting Letters of Administration in and for the County of Adams, and State of Pennsylvania, personally came Nicholas Stents and John Johns, the subscribing Witnesses to the foregoing instrument of writing, who on their Solemon oath & affirmation do severally say that they were personally present and saw and heard the therein name as John Aulabaugh acknowledge the above signature and Seal to be his and publish the foregoing instrument of writing, as and for his last Will & Testament, and at the time of doing thereof he the said John Aulabaugh was of sound and disposing mind, memory and understanding, to the best of their knowledge, observation and belief, and that they subscribed their names thereto as witnesses in his presence, and at his request, and also in the presence of each other at the same time.

Memorandum, Letters Testamentary was on the day granted in due form of Law to John, Absalom and Jeremiah Aulabaugh, the Executors of the last Will & Testament of John Aulabaugh Esq. deceased,, an Inventory to be exhibited into the Registers office at Gettysburg, in the county of Adams, within thirty days from the date hereof, and a fast and true account of their Administration within one year from the date hereof or when thereunto legally acquired, Witness my hand the 11th day of October A.D. 1843
