Thomas Jiames to George Albaugh

This Indenture made this eleventh day of
April in the year of our Lord one thousand eight hundred and twenty nine between
Thomas Jiames and Farley his wife of the County of Tuscarawas and State of Ohio
of the one part, and George Albaugh of Jefferson County and State of Ohio of the
other part, Witnesseth, that the said Thomas Jiames and Farley his wife, for and
in consideration of the sum of sixty one dollars and twenty five cents, to them
in hand paid, the receipt whereof is hereby acknowledged, have granted,
bargained and sold, and by these presents do grant, bargain, sell, convey and
confirm unto the said George Albaugh his heirs or assigns, all the following
described tract or parcel of land with the appurtenances, situate lying and
being in the County of Jefferson and State of Ohio, and being the one eighth
tract of the south west quarter of section number seven in Township number
Twelve in Range number four of the land directed to be sold at Steubenville. To
have and to hold the above described tract or parcel of land and premises, with
the appurtenances, to the said George Albaugh his heirs and assigns to the only
proper use and behoof of him the said George Albaugh his heirs and assigns
forever. And the said Thomas Jiames and Farley his wife for themselves, and
their heirs, executors and administrators, do and hereby covenant and agree to
and with the said George Albaugh his heirs and assigns that the said Thomas
Jiames and Farley his wife, the above described tract or parcel of land, and
premises to the said George Albaugh his heirs and assigns, shall and will
warrant, and forever defend against all lawful claims whatsoever ~ In Testimony
whereof the aforesaid Thomas Jiames and Farley his wife have hereunto set their
hands and seals the day and year first above
written. On the eleventh day of April in the year of
our Lord one thousand eight hundred and twenty nine – personally appeared before
me one of the Justices of the Peace in said County, the above named Thomas
Jiames and Farley his wife, and severally acknowledged the above instrument of
writing to be their voluntary act and deed for the purposes therein expressed,
and requested the same might be recorded as such. She the said Farley being by
me personally examined separate and apart from her said husband and out declared
that she signed, and as her act and deed delivered the same without any coercion
or compulsion, from her said husband. Given under my hand and seal the day and
year above written. |
