11 May 1792  Francis Harter to Daniel Albaugh

                 At the request of Daniel Albaugh the following Deed was recorded
                11th May 1792.  To Wit ~

This Indenture made this eighth day of May in the year of our Lord one thousand seven hundred and ninety two Between Francis Harter of Washington County and State of Maryland, Carpenter of the one part, and Daniel Albaugh, Weaver, of Frederick County and State aforesaid of the other part  Witnesseth that the said Francis Harter for and in consideration of the sum of twelve pounds current money to him in hand paid by the said Daniel Albaugh the receipt whereof the said Francis Harter doth hereby acknowledge and himself to be fully satisfied contented and paid, and for and in consideration of the yearly Ground rent of seven shillings and six pence current money to be paid unto John Young or his Assigns during his natural life and then to be paid unto Richard Coale or to his Heirs Executors Administrators and Assigns yearly and every year hereafter forever on the twenty second day of June for every year as aforesaid, and the said Francis Harter hath given granted bargained sold aliened released and confirmed, and by these presents doth give grant bargain sell alien release and confirm unto him the said Daniel Albaugh his Heirs and Assigns forever all  his the said Francis Harters' right Title Interest claim and property of in and to all the following Lott of Ground in  the Town of Liberty in Frederick County aforesaid and Albaugh of Linganore called Piney Run being part of a Tract of Land called Dukes Woods and lying on the South side of the Main Street in said Town and known by its Number which is 96 in the said Town, and Beginning at a Stone set up and marked , (D & AB together) and running thence South four degrees East three hundred feet then South eighty six degrees West fifty feet then North four degrees West three hundred feet then by a straight line to the Beginning containing one of the aforesaid Town Lotts Together with all and singular the Buildings and Improvements and all the premises and Appurtenances to the said Lott belonging or in any wise appertaining.  To have and to hold the said Lott of Ground together with the premises and Appurtenances  to and of the within mentioned Lott of Ground unto him the said David Albaugh his Heirs and Assigns to the only proper use and Behoof of him the said Daniel Albaugh his Heirs and Assigns and to no other use Intent or purpose whatsoever ~~  And the said Francis Harter for himself and his Heirs doth hereby consonant promise grant and agree to and with the said David Albaugh his Heirs and Assigns that he the said Francis Harter and his Heirs shall and will from time to time and at all times warrant and defend the said Lott of Ground and premises against all manner or persons claiming any right Title Interest or Property by or under him the said Francis Harter his certain  Attorney Heirs Executors Administrators or Assigns ~~

And he the said Francis Harter doth further consonant for himself his Heirs to and with the said Daniel Albaugh his Heirs and Assigns that he the said Francis Harter and his Heirs shall and will from time to time and at all times forever hereafter and at the proper cost and Charges of him the said Daniel Albaugh his Heirs and Assigns do make acknowledge suffer execute or cause to be executed all and every such further Act  or Acts thing or Things or Conveyances in the Law as by the said Daniel Albaugh his Heirs and Assigns or his or their Council learned in its Law as shall be reasonably devised advised or require for the further and better Assurances Surety and Suremaking of all and singular the premises hereby bargained and sold or intended to  be hereby bargained and sold according to his true Intent and Meaning of these presents.  In Witness whereof the said Francis Harter hath hereunto set his Hand and affixed his Seal the day and Year within written

Which was thus endorsed to wit

Received the 8th day of May 1792 of Daniel Albaugh the sum of Twelve pounds current Money the Consideration expressed in the within Deed except the yearly ground rent of seven shillings and six pence current money mentioned in the written Deed.                               Francis Harter

On the 8th day of May 1792 came the within named Francis Harter before us two Justice of the Peace for Washington County and acknowledged this within Instrument of Writing to be his Act and Deed and this Lott and Premises therein mentioned to be the right and Estate of Daniel Albaugh his Heirs and Assigns forever ~~  And at the same time came Catharine Harter the wife of him the said Francis Harter who being examined by us privately and out of the hearing of her said husband acknowledged that she relinquished her right and dower in the said Lott of Ground and that she did without being compelled by her husband thereto by fear or threats or gaining his displeasure.                    Alex’r Clagett        Ad’m Ott

                I do hereby certify that Alexander Clagett and Adam Ott Gentlemen before whom the above Acknowledged was taken and when Names appear thereto subscribed are two of the Justice of the Peace of the said in and for said County duly commissioned and sworn
