John Hane to Samuel Albaugh

Granted } At the request of Samuel Albaugh the
following Deed is This Indenture made this ninth day of May in the year of our Lord one thousand eight hundred and twenty eight between John Hane of Frederick County in the State of Maryland, of the one part and Samuel Albaugh of the county and state aforesaid of the other part. Witnesseth that the said John Hane for and in consideration of the sum of five hundred Dollars current money of the United States to him in hand paid by the said Samuel Albaugh before the sealing and delivery of these presents the receipt whereof he the said John Hane doth hereby acknowledge, hath granted, bargained, sold, aliened, enfeoffed and confirmed, and by these presents doth grant bargain, sell alien, enfeoff and confirm unto the said Samuel Albaugh his heirs and assigns all the following described piece or parcel of ground situate , lying and being in Frederick town in the county and State aforesaid being part of that parcel of ground which was conveyed by John Mantz to William and Daniel Hane by deed dated on or about the fifteenth day of May one thousand eight hundred and seventeen and afterwards conveyed to the said John Hane by John Nelson Esq. Trustee under a decree of Frederick County as a Court of Chancery by deed dated on or about the twenty eighth day of June one thousand eight hundred & twenty seven. Beginning for the part of said Lot hereby intended to be conveyed to said John Hane and running with all Laints street, West one hundred and eighty eight feet, North thirty one feet east one hundred and eighty eight feet then South with Market Street thirty one feet to the Beginning Together with all and singular the buildings improvements, hereditaments and appurtenances, whatsoever thereunto belonging or in any wise appertaining, and the reversions and remainders, rents, issues and profits thereof, and all the estate, right, title and interest whatsoever of him the said John Hane both at Law and equity, of, in, to, and out of the said piece or parcel of ground and premises hereby bargained and sold, or meant, mentioned or intended hereby to be and every or any part and parcel thereof: To have and to hold the said piece of ground and premises so as aforesaid described together with the buildings and appurtenances, and all and singular other the premises herby bargained and sold, or meant mentioned or intended hereby so to be and every part or parcel thereof with their and every of their appurtenances, unto the said Samuel Albaugh his heirs and assigns forever and to and for no other use, intent or purpose whatsoever and the said John Hane for himself his heirs executors and administrators, doth hereby covenant grant promise and agree to and with the said Samuel Albaugh his heirs, executors, administrators or assigns that he the said John Hane and his heirs that said piece or parcel of ground and premises hereby granted, bargained and sold, and every part and parcel thereof with the appurtenances thereunto Belonging to him the said Samuel Albaugh his heirs and assigns against him the said John Hane and his heirs and against all and every person or persons whatsoever claiming or to claim any right, title or interest in and to the same or any part thereof from by or under him or them or any of them shall and will hereafter warrant and forever defend by these presents. In witness whereof the said John Hane hath hereunto subscribed his name and affixed his seal the day and year first herein before written. Signed, sealed and delivered in the presence
of } John Hane (seal) Which is thus endorsed On this ninth day of May in the year of our
Lord one thousand eight hundred and twenty eight personally appeared John Hane
being the grantor named in the above Instrument, before us the Subscribers two
Justices of the Peace in and for said county and acknowledge the above
Instrument of writing to be his act and deed and the piece of ground & premises
therein mentioned and thereby bargained and sold to be the right and estate of
the within named Samuel Albaugh party grantee also therein named his heir and
assigns forever according to the purport true intent and meaning of the said
instrument of writing, and the acts of assembly in such case made and provided
and at the same time also personally appeared Margaret Hane wife of the said
John Hane before us Justices as aforesaid and acknowledge the said Deed or
instrument of writing to be her act and deed and the piece of ground and
premises therein mentioned to be the right and estate of the within named
Samuel Albaugh his heirs and assigns forever and the said Margaret Hane being
also by us privately examined apart from and out of the hearing of her husband
acknowledge that she doth make her acknowledgement of the same willingly and
freely, and without being induced thereto by fear or threats of ill usage by her
husband or fear of his displeasure.
