George Albaugh to Morris Albaugh

Exe'd del'd & Recorded  }                     At the request of Morris Albaugh the following Deed was
13th Nov 1804             }                       recorded November 12th 1799,   to wit ~~

This Indenture made this eighth day of November one thousand seven hundred and ninety nine  Between George Albaugh of Frederick County and State of Maryland of the one part and Morris Albaugh of Ann Arundel County and State aforesaid of the other part.  Witnesseth that he the said George Albaugh for and in consideration of the sum of one hundred pounds current money to him in hand paid by the said Morris Albaugh at or before the ensealing and delivery of these presents, the receipt whereof he the said George Albaugh doth hereby acknowledge.  Hath given granted, bargained and sold, aliened enfeoffed and confirmed, and by these presents doth give, grant, bargain and sell, alien release, enfeoff and confirm unto him the said Morris Albaugh, his heirs and assigns forever.  All that piece part or parcel of land and premises situate lying and being in the County of Frederick and State aforesaid being part of Lott No. 1, which Number One, is part of “Monocacy Manor” and which said part or parcel of Land was on or upon the fourth day of November in the year of our Lord one thousand seven hundred and ninety five conveyed by William Dern to the said George Albaugh and recorded in Liber WR No. 13 folios 618 and 619.  One of the land records of Frederick County aforesaid as will appear by reference being thereunto had.  Beginning at the part of said Lott No. 1 at a stone planted at the end of the fifth line of said Lott No. One and running thence with the sixth line thereof as surveyed by George Dent Esq. In the year one thousand seven hundred and eighty two South eight degrees East twenty perches to a stone planted on the north seventy four degrees East line of Monocacy Manor aforesaid then by and with said line reversed as surveyed at the time aforesaid South seventy three degree west eight and a quarter perches to a stone planted then North four and three quarters degrees, west  twenty and a quarter perches to a stone planted on the fifth line of Lot No. 1 aforesaid then by and with said line to the Beginning Stone containing one acre of Land more or less.  Together with all and singular the houses, buildings, improvements, rights, members and appurtenances whatsoever to the said piece, part or parcel of Land and premises belonging or in any wise appertaining.  And all the estate right, title, property, interest, benefit, claim and demand whatsoever in Land and in Equity of him the said George Albaugh of in and to the within described piece, part or parcel of land and premises and every part thereof,  To have and to hold the said piece or parcel of land and premises with the appurtenances and every apart thereof unto him the said Morris Albaugh his heirs and assigns to the only proper use benefit and behoof of him the said Morris Albaugh his heirs and assigns forever, and to and for no other use intent and purpose whatsoever.  And he the said George Albaugh for himself and his heirs the aforesaid piece or parcel of Land and premises with the appurtenances and every part thereof unto him the said Morris Albaugh his heirs and assigns shall and will warrant and forever defend by these presents from and against him the said George Albaugh his heirs executors and administrators and from and against all and every other person or persons whatsoever claiming or that shall or may hereafter  claim any right or title thereto by from or under him them, or in any of them.  And Lastly, that he the said George Albaugh and his heirs shall and will at any time hereafter at the request cost and charges in the Law of him the said Morris Albaugh his heirs or assigns execute and acknowledge any other deed or other Instrument of writing  as shall be thought lawfully necessary for the better and more sure and perfect granting and conveying in fee simple by like warranty the within described piece or parcel of land and premises unto him the said Morris Albaugh his heirs and assigns forever according to the true intent and meaning of these presents.  In Witness whereof he the said George Albaugh hath hereunto set his hand and affixed his seal the day and year first within written.

State of Maryland   }   On the day and year first within written Came the within named George Albaugh before us the subscribers two of the Justices of the Peace for said County and acknowledged the within Instrument of Writing to be his Act and deed, and the piece part or parcel of Land and premises thereby granted to be the right and estate of the within named Morris Albaugh his heirs and assigns forever, according to the true intent and meaning of these presents.  At the same time came also Catherine wife of him the said George Albaugh who being privately examined by us apart from and out of the hearing of her said husband did relinquish all her right of dower to the within described piece, part or parcel of Land and premises, and declared that she did the same of her own free will without threats or compulsion from her said husband or through fear of his displeasure.
