Daniel Fundenburg to William Alback

} At the request of William Albach the following Deed is
recorded This Indenture made the twelfth day of May, in the year of our Lord one thousand eight hundred and fifteen Between Daniel Fundenburg of Frederick County and state of Maryland , of the one part and William Alback of William Alback and state of Maryland of the other part, Witnesseth, that the said Daniel Fundenburg, for and in consideration of the sum of Forty Dollars current money of the United States, to him in hand paid or secures to be paid, by the said William Alback on or before the sealing and delivery of these presents the receipt whereof he doth hereby acknowledge, and thereof and there from doth release, acquit and discharge the said William Alback his heirs, executors and administrators, and every of them by these presents, hath given, granted, bargained, sold, aliened, released, enfeoffed and confirmed, and by these presents doth give grant, bargain, sell, alien, release, enfeoff and confirm unto the said William Albach his heirs and assigns for ever, all the following described lot or piece of land, situate, lying and being in Lewistown, Frederick County and State of Maryland, and known on the general plain of said town by the No. 195. Beginning at lot No. 194 thence south seventy five and a half degrees west one hundred and eighty feet to a twenty feet alley, thence south twelve and a half degrees East sixty feet to lot No. 196 thence North seventy five and a half degrees East one hundred and eighty feet to a twenty feet alley thence North twelve and a half degrees west sixty feet to the Beginning (said Town was laid out by the said Daniel Fundenburg on a tract of land composed of parts of Cooper’s point, Miller’s Chance, and Cossell’s Desire, situate in the county and state aforesaid) ~ Together with all and singular the houses, buildings, gardens, orchards, ways, waters, watercourses, timbers, timber trees, woods, underwoods, profits, commodities, easements, advantages and appurtenances whatsoever is unto the same belonging or in any wise appertaining and the reversion and reversions remainder and remainders, rents, Issues and profits, of the said lot hereby granted, bargained and sold, or meant, mentioned or intended so to be and every part and parcel thereof and all the estate, right, title, Interest, use, trust, property, possession, claim and demand whatsoever of the said Daniel Fundenburg, of into or out of the same, and remises with the appurtenances. To have and to hold the said Lot of ground herein and hereby granted, bargained, and sold, meant, mentioned or intended so to be and premises with the appurtenances, and every and parcel thereof unto the said William Alback, his heirs and assigns forever ~~ Subject to payment of thirty dollars on the twelfth day of May A.D. 1816 and the like sum of thirty dollars on the twelfth day of May A.D. 1817 for which payments notes are given to the said Daniel Fundenburg And the said Daniel Fundenburg for himself and his heirs and assigns, doth hereby covenant to and with the said William Alback his heirs to warrant and forever defend the said lots and premises with the appurtenances unto the said William Alback his heirs and assigns, against him the said Daniel Fundenburg his heirs and assigns, and against all other persons claims or demands. And further the said Daniel Fundenburg and his heirs will from time to time and at all times at the reasonable request and proper costs and charges of the said William Alback his heirs and assigns, do execute and perform such other matter or instruments of writing as may conduce to the more firm conveyance and better security of the above described lot and premises. In witness whereof I, the said Daniel Fundenburg have hereunto set my hand and seal the day and year first above written. Signed sealed and Delivered
} Daniel Fundenburg (seal) Frederick County, To Wit, Which is thus endorsed, to wit ~~ On the Eighteenth day of May, in the year of
our Lord one thousand eight hundred and fifteen came before is, the subscribers,
two Justices of the Peace for the county aforesaid the within named Daniel
Fundenburg, and acknowledged the above instrument of writing to be his act and
deed, and the lot or piece of land and premises therein mentioned with the
appurtenances, to be the right and estate of the within named William Alback his
heirs and assigns forever. At the same time came Rebecca, the wife of the said
Daniel Fundenburg, and being by us privately examined, apart from and out of the
hearing of her said husband, did release and relinquish all her right and title
of dower of in and to the said lot and premises and she declared that she did
the same, and made thus her acknowledgement freely and voluntarily, without
being induced thereto by fear or threats of or ill usage from her said husband,
or through fear of his displeasure, according to the true intent and meaning of
the same and the act of assembly in such case made and provided.
