Francis Harter to Daniel AlbaughLand Records, Frederick, MD Examined and Granted } At the request of Daniel
Albaugh the following deed This Indenture made the tenth day of April in the year of our Lord one thousand seven hundred and eighty eight Between Francis Harter of Frederick County and State of Maryland, Carpenter of the one part and Daniel Albaugh, Weaver, of the same county and State aforesaid of the other part. Witnesseth that the said Francis Harter for and in consideration of the sum of twelve pounds current Gold and Silver Money to him in hand paid by the said Daniel Albaugh the receipt whereof the said Francis Harter doth hereby acknowledge, and for and in consideration of the yearly rent of seven shillings and six pence current Gold and Silver Money to be paid to Richard Coale or to his Heirs Executors Administrators yearly and every year forever which said Annuity commence on the 22nd day of June last~ The aforesaid Francis Harter hath given granted bargained sold aliened released and confirmed and by these presents doth give grant bargain sell alien release and confirm unto him the said Daniel Albaugh his Heirs and Assigns forever All his the said Francis Harter’s Right Titles Interest and property of in and to all the following Lott of Ground in the Town of Liberty in Frederick County aforesaid on a Draught of Linganore called Piney Run being part of a Tract of Land called Dukes Woods, the said Lott being numbered Thirty Five in the said Town - Beginning at a stone marked DÆ (AB together), and running thence South four degrees East three hundred feet, then South eighty six degrees West fifty feet North four degrees West three hundred feet then by a straight line to the Beginning containing one of the Town Lotts Together with all and singular the Buildings and Improvements, and all the premises and appurtenances to the said Lott belonging, or in anywise appertaining To have and to hold the said Lott of Ground together with the premises and Appurtenances on the conditions above mentioned unto him the said Daniel Albaugh his heirs and Assigns forever, to the only proper use and behoof of him the said Daniel Albaugh his Heirs and Assigns and to no other use Intent or purpose whatsoever~ And the said Francis Harter for himself and his Heirs doth hereby consonant promise grant and agree to and with the said Daniel Albaugh his Heirs and Assigns that he the said Francis Harter and his heirs shall and will from time to time, and at all times forever warrant and defend the said Lott of Ground, and premises with its appurtenances against all manner of persons claiming or to claim right Title Interest or property unto the aforesaid Lott of Ground and premises with its appurtenances from by or under him the said Francis Harter and his Heirs. And the said Francis Harter doth further consonant for himself and his Heirs to and with the said Daniel Albaugh his Heirs and Assigns that he the said Francis Harter and his Heirs shall and will from time to time, and at all Times forever hereafter at the proper Cost and Charges for him the said Daniel Albaugh his Heirs or Assigns do make acknowledge suffer execute or cause to be made done acknowledged suffered and executed all every such further and other Act or Acts Thing or Things or Conveyance in the Law as by the said Daniel Albaugh his heirs and Assigns or his or their Council learned in the Law shall be reasonably devised advised or required for the further and better Assurances Surety and Suremaking of all and singular the premises hereby bargained and sold or intended to be bargained and sold according to the true Intent and Meaning of these presents. Upton Sheredine On the back whereof were thus endorsed On the 10th day of April 1798 Came the within named Francis Harter before us two Justices of the Peace for Frederick County and acknowledged the within Instrument of Writing to be his Act or deed, and the Lott of Ground and premises therein mentioned to be the right and Estate of the within named Daniel Albaugh his Heirs and Assigns forever~~ And at the same time came Catharine Harter the wife of the said Francis Harter who being examined by us privately and out of the hearing of her said husband declared that she relinquished her Right of Dower in the said Lott, and that she did the same freely and voluntarily without being compelled thereto by fear Threats of her said husband, or fear of is displeasure Upton Sheredine Wm Beatty
