Peter Fox to John Albaugh
Land Records, Frederick MD Examd and del.d Granted } At the request
of John Albaugh the following deed was recorded This Indenture made this twentieth day of August one thousand seven hundred and ninety five Between Peter Fox of Frederick County in the state of Maryland of the one part, and John Albaugh jun of the same county and State of the other part Witnesseth that the said Peter Fox for and in consideration of the sum of three hundred and three pounds current money to him in hand paid the receipt whereas he doth hereby acknowledge and himself to be therewith satisfied and contented Hath given granted bargained sold aliened enfeoffed and confirmed, and by these presents doth give grant bargain sell alien enfeoff and confirm unto the said John Albaugh jun and his heirs all the two following pieces or parcels of Land being part of a tract of land called Spring Garden and part of a tract of land called the resurvey on Good Neighborhood lying and being in Frederick County and State aforesaid Beginning for the outlines of the said two pieces of land at the end of sixty six perches on the second line of Jacob Shoemakers part of the Resurvey on Good Neighborhood and from thence by a line dividing? the Tract South one degree and a quarter of a degree West ninety four perches and two lengths of a perch to the out lines of the whole tract called the Resurvey on Good Neighborhood, and with said land revised as bounded North seventy degrees East sixty six perches and four tenths of a perch then North ten degrees and three quarters of a degree East eighteen perches and three tenths of a perch to a Stone at the end of the first Line of that part of the resurvey on Spring Garden conveyed to Peter Fox by Jacob Stoner, then with said land the two following courses North seventy two degrees East ninety perches and two tenths of a perch to a Stone then North thirty minutes West nine perches to a Stone then North seventy two degrees and three quarters of a degree East fifty seven perches and an half perch to a Stone North thirty four degrees East fifty three perches and four tenths of a perch to a Stone, a course of John Shoemakers land, and with said land North forty five degrees and an half degree West twenty four perches and six tenths of a perch to a stone North twenty two degrees West seventy five perches to a Stone then South seventy three degrees and three quarters of a degree West six perches and seven tenths of a perch to the end of the third line of Jacob Shoemakers land, and with said line revised South twenty two degrees East seventy two perches then with a straight line to the Beginning containing one hundred and one acres of land together with all and singular the premises and appurtenances to the two said pieces or parcels of land belonging or in anywise appertaining. To have and to hold the two said pieces of land together with the premises and appurtenances thereunto belonging unto him the said John Albaugh junr his heirs and assigns and to no other use intent or purpose whatsoever ~~ And the said Peter Fox for himself and his heirs the said pieces or parcels of land and premises and every part thereof against him and his heirs and against all and every other person and persons whatsoever to the said John Albaugh his heirs and assigns shall and will warrant and forever defend by these presents. 1795 of John Albaugh the sum of three hundred pounds current money it being the
consideration money within mentioned. As witness my hand Peter Fox On the 20th day of August 1795
came the within named John Albaugh before us two Justices of Frederick County,
and acknowledged the within deed to be his act and deed and the land and
premises therein mentioned to be the right and estate of the within named John
Albaugh his heirs and assigns forever. At the same time came Margaret wife of
the said John Albaugh before us and being privately examined apart from and out
of the hearing of her said husband declared that she relinquished her right of
Dower in the within lands and premises, and that she did the same freely and
voluntarily without being induced thereto by fear or threats of ill usage by her
said husband or for fear of his displeasure. |
