Peter Fox to John Albough Jr.
Land Records, Frederick MD Ex. Del. Granted } At the request of
John Albaugh the following deed was recorded This Indenture made this tenth day of April one thousand seven hundred and ninety seven. Between Peter Fox of Frederick County in the State of Maryland of the one part and John Albough jun of the same county and state of the other part. Witnesseth that the said Peter Fox for and in consideration of the sum of three hundred and three pounds current money to him in hand paid by the said John Albough the receipt whereof he doth hereby acknowledge and himself therewith to be fully satisfied contented and paid and also to confirm a deed made by said Fox to Albough on the 20th of August one thousand seven hundred & ninety five for the same Lands hath given granted bargained and sold aliened enfeoffed and confirmed and by these presents Doth give grant bargain and sell alien enfeoff and confirm unto the paid John Albough jun and his heirs all the two following pieces or parcels of land being part of a Tract of Land called Spring Garden and part of a tract of land called the Resurvey on Good Neighborhood lying and being in Frederick County and state of Maryland. Beginning for the outlines of the two said pieces of land at the end of sixty six perches on the second line of Jacob Shoemakers part of the Resurvey on Good Neighborhood and from thence by a line dividing the tract South one degree and a quarter of a degree West ninety four perches and two tenths of a perch to the out lines of the whole tract called Resurvey on Good Neighborhood and with said Land Reversed as bounded North seventy degrees Ease sixty six perches and four tenths of a perch then North ten degrees and three quarters of a degree East eighteen perches and three tenths of a perch to a stone at the end of the first line of that part of the Resurvey on Spring Garden conveyed to Peter Fox by Jacob Stoner then with said land the two following courses North seventy two degrees East ninety perches and two tenths of a perch to a stone then North thirty minutes West nine perches to a stone then North seventy two degrees and three quarters of a degree. East fifty seven perches and a half perch to a stone North thirty four degrees East fifty three perches and four tenths of a perch to a stone a Corner of John Shoemakers land with said land North forty five degrees and a half degree West twenty four perches and six tenths of a perch to a stone North twenty two degrees West seventy two perches to a stone then south three degrees and three quarters of a degree West six perches and seven tenths of a perch to the end of the third line of Jacob Shoemakers land and with said line reversed South twenty two degrees East seventy two perches then with a straight line to the Beginning containing one hundred and one acres of land. Together with all and singular the premises and appurtenances to the said two pieces of land belonging or in any wise appertaining. To have and to hold the two said pieces of land Together with the premises and appurtenances thereunto belonging unto him the said John Albough jun his heirs and assigns forever to the only proper use & behoof of him the said John Albough jun his heirs and assigns and to no other use intent or purpose whatsoever. And the said Peter Fox for himself and his heirs the said pieces or parcels of land and premises and every part thereof against him and his heirs and against all and every other person or persons whatsoever to he said John Albough his heirs assigns shall and will warrant and forever defend by there presents. Sappington } On the 10th day of April 1797
Came the within named Peter Fox before us two Justices of the Peace for
Frederick County and acknowledged the within Deed to be his Act and Deed and the
lands and premises therein mentioned to be the Right title and Estate of the
within named John Albough jun his heirs and assigns forever. At the same time
came Margaretta wife of the said Peter Fox and being by us examined apart from
and out of the hearing of her husband relinquished her Roght of Dower to the
said lands and premises and said she did the same freely and voluntarily and not
thro force or fear of her husbands displeasure - |
